Summer was officially over on Labor Day in San Bernardino County’s smallest and without a doubt hottest city, but temperatures were on the rise again at the Needles City Council meeting on Tuesday, September 13. In a packed room that included most of the nine candidates running for three seats on the city council and their supporters, some ugliness emerged in what was supposed to be a topic concerning beautification of the town. An ignited debate ensued about how to literally clean up the town’s blight and unsafe conditions using the county sheriff’s department to enforce city codes.
Shawn Gudmundsen, who requested the discussion item be included on the agenda, suggested that a path to obtain the assistance on the county sheriff’s deputies on code enforcement be found, especially in consideration of the amount the city is now paying them over and above that which was budgeted for. Earlier in the evening an agenda item had been voted on to increase the payment on the Sheriff’s contract by roughly $140,000 due to salary increases as an outcome of the negotiations with the union over payroll.
Rick Daniels, city manager, explained that in anticipation of pay raises this year, the city had budgeted for an extra $60,000 to $70,000, but that amount was insufficient. Both council members Louise Evans and Shawn Gudmundsen voted against the increase, reasoning that $2.4 million dollars for police services on a total town budget of just a little over $5 million was more than the city can afford. Gudmundsen added an objection to the effect that he knew of activities the sheriff’s department was engaged in at the Needles substation that were unrelated to the city’s service needs he did not think the city should be paying for. Councilman Tom Darcy, on the other hand voted for the increase even after making the pronouncement “They should be doing a better job closing the excess over what we budget for.”
One un-uniformed deputy Pat Murch, a former council member, was present in the audience in plain clothes. He took note of Gudmundsen’s suggestion that the deputies begin to enforce local civil codes and indicated his distaste for the idea by approaching the lectern. He let Gudmundsen have it, saying that anyone who thinks that the sheriff’s department is there to enforce civil matters needs to go “get an education. We don’t do civil matters. We do criminal law.” Responding to Mr. Murch, the city attorney, John Pinkney, formerly with Best, Best and Krieger, suggested that he be tasked with looking into the matter with regard to areas of law in which the contracted law enforcement agency might be able to assist with local code enforcement. Daniels interjected that “it is not a crime to have an ugly house, but if the situation rises to a level of public safety or nuisance then local government can do something about it.”
Daniels further asserted that in light of all of the new construction involving the erection of buildings to be used for “grow houses” in conjunction with the emerging cannabis farming industry in the community, the demand upon the city’s sole code enforcement officer’s time is becoming problematic since he also doubles as the building inspector. Daniels reiterated a plan that he had previously presented to the council involving a firm that would be contracted to do just the building inspection for the marijuana industry construction projects, saying that the cost of the contract would be borne by the cannabis growers and cooperatives.
Jeff Williams, whose brother, Dan Williams, is the code enforcement officer for the city, objected to a contractual arrangement that could take from potential local employment. Evans also indicated her desire for more local employment and her objection to contracting the work.
Ruth Musser-Lopez, the administrator for a local association calling itself the “Needles Fire Auxiliary,” suggested that the council consider the potential of returning the fire protection services to a local fire department where the fire chief functions as a code enforcement official enforcing codes pertaining to fire safety and hazards as well as inspecting operations, equipment and appurtenances such as fire hydrants. She said that the hiring of a fire chief would relieve the current code enforcement officer of some of his duties so that he could act in the capacity of building inspector.
Musser-Lopez thanked the council for removing an agenda item concerning the declaration of the city’s fire station as “surplus” and beginning the reception of proposals for lease or purchase of the structure. She said that the fire station cannot be considered surplus until an election takes place on the voter initiative. She claimed that 160 signatures had been collected on the petition and that it those were sufficient to bring the initiative to a vote at the next election but that the auxiliary is considering collecting 80 more signatures to a total of 15 percent of the city’s voters, which by law would hasten that time by forcing a special election. She said that because of the cost of a special election, the auxiliary is waiting to see if a new council in November would approve the initiative on its own authority and de-annex the city from the taxed county fire district while reinstating the city’s fire department. She said that should the new council decide to reinstate the fire department, it would need a fire chief and that the charter requires that the fire chief be responsible for code enforcement as it pertains to the fire protection and safety services. She noted the fire hydrant at the Chestnut Street fire that was non functional and said that this could have been avoided by regular inspections and flushing of the system. Musser-Lopez, one of nine candidates for Needles City Council this November, has made public the pronouncement that the re-instatement of a local fire department was something that she hoped to usher in if elected to the council.
Daniels, in defense of the takeover of the fire protection services by the county fire district said that the county’s fire chief, Mark Hartwig, had begun a program of regularly inspecting the fire hydrants. A retired water treatment and distribution operator has anonymously informed the Sentinel however, that “it is unlikely that county is inspecting the valves since the city’s system is aged and valves in aged systems break with regularity. In most American cities, the water utility is traditionally responsible for exercising all valves in its water distribution system including the exercise and testing of fire hydrants.” In addition, this retired operator suggested that “any testing for minimum fire flow in the Gates Subdivision of Needles would reveal inadequate fire flow in the hydrants. The lack of adequate fire flow would definitely affect the insurance rating of homes in the Gates Subdivision in Needles, causing their rates to increase.”
Daniels maintained at the council meeting that the county fire district will offer work days by prisoners. He said that there will be 18 people on a crew to work 3 days in the community to clean up and remove debris as well as cut back the brush and a carry out a variety of other tasks, including cutting and trimming the hedges at the El Garces train depot. He said that he is working with the fire chief to get those areas cleaned up. Daniels also said that there were 200 illegal dumps in the community that the city has allegedly cleaned up and he also described two programs: a no-cost welfare-to-work county program where the human services department will provide employees to the city at no cost while the workers receive job training; and a bulk trash pick-up program offered to sanitation customers at no extra charge.
As the meeting drew to a close councilman Darcy resurrected the topic of the return of the fire department to the city’s control, counseling those in attendance who would suggest that the fire hydrants were in disrepair. He said it was a problem of a homeowner who kept a disconnected fire hydrant in his yard for ornamental purposes. On at least two previous occasions at council meetings, the issue of problematic fire hydrants at the “Chestnut fire” had been discussed and at this meeting Daniels corrected Darcy repeating that there were two problematic fire hydrants involved at the Chestnut fire—both the ornamental hydrant and another one that was non-functional due to breakage during manipulation of the valve. Darcy shrugged the fire hydrant issue off and redirected his “counseling” saying that the fire station was old and its useful life was gone. He further discouraged the idea of a city-run fire department, saying that the community composition was such that those who volunteered at one time were now old and retired and that a volunteer fire department would cause everyone’s insurance costs to skyrocket because of the lowering of the safety rating. Darcy’s pronouncement made no reference to language in the voter initiative calling for a professional full time city fire department with an ISO rating the same or higher than what it currently has with the county operating it.
After the meeting’s adjournment, a melee broke out after some residents got involved in a heated exchange in which it was alleged that a local news organization was uncritically accepting and publishing one-sided information that originated with government officials, while another contingent suggested that yet another news organization was exhibiting an anti-government bias. At issue in the argument was an accusation that Needles city government is acquiescing in the proliferation of an extremely unhealthy environment in the city’s downtown area, including the so-called “shooting gallery,” i.e., Needles’ skid row where users of the drugs heroin and methamphetamine congregate to share syringes and intravenously inject those drugs. This has led to an AIDS epidemic that is going unaddressed, one resident stated. This circumstance either coexists with or is exacerbated by city officials’ acquiescence in calculated neglect of the area which has redounded to the financial benefit of property owners of the dilapidated property, one individual said. Specifically, it was stated, the owner of one building that was destroyed in an apparent arson fire is a former city official who had the house insured for $500,000 through the Jernigan Insurance Company when the value of the property could not have been more than $50,000. It was alleged city officials were doubly complicit in this fraud by both allowing the underlying conditions that led to the fire and an orchestrated cover-up after the fact. According to this version of events, city manager Rick Daniels ordered that the crime scene be bulldozed before the arson investigator visited the site, thwarting any possibility that the fraud would be uncovered.
All of this talk, including such accusations against city officials, was apparently too much for some of those present to take, and when one of those involved in the heated exchange advanced upon the other, councilman Jeff Williams valiantly waded into the fracas between the two, preventing them from inflicting mayhem upon one another. Both then retreated into the steamy, moonlit desert.
“Red tag” is the term used locally to denote what is done at residences where the electric and water bill has not been paid. A red flyer is left by the city informing the occupants that their electricity and water will be shut off. One dilapidated abode along the shooting gallery had been red tagged.
An informed source told the Sentinel that earlier this week there was a death related to methamphetamine use in a local Needles hotel and that the electricity, which had previously been turned off at one of the properties within the “shooting gallery,” had been turned back on.

I have been told, by an extremely well-placed individual, that the most recent effort to legislate reform with how California’s hopelessly corrupt Public Utilities Commission does business failed because our equally hopelessly corrupt governor threatened to veto any meaningful reform legislation that would be passed. Since no legislation was actually passed and these supposed veto threats occurred on the QT behind closed doors, no one, and that includes me, is in a position to prove anything. What is well known, however, is that last year, when a raft of reform bills was passed and placed on his desk, Governor Jerry Brown vetoed them all. His justification? They were contradictory and unworkable, he said…
It was fairly obvious that he was trying to avoid bringing the house of cards down upon himself and so, earlier this year, he made it appear as if he was ready to seriously entertain signing off on a reform package the legislature might deign to put together this summer. This came in the aftermath of the Assembly’s passage by an overwhelming margin, in June, of a constitutional amendment to denude the utilities commission of a significant degree of its authority. The Assembly was set to layer into the mix the authorization of an independent internal auditor to review commission decisions. Another safeguard the Assembly wanted was the prohibition of former utility executives from leaving employment with a utility and jumping immediately onto the commission. The reform would have made them wait at least two years to do that. Those reforms were supposed to be placed into Senate Bill 1017 and Assembly Bill 2903. And the new law would have made it a misdemeanor for utilities commission employees or board members to release to anyone – including competing utility companies or their parent companies or their lawyers or their investors or their stockholders – information deemed confidential or proprietary by utility companies. But, it turns out, some of the current members of the commission didn’t like those proposed changes…
What I am told is Governor Brown let it be known, quietly, he was ready to use his veto power again on these laws. Supposedly, this veto threat was justified by the assertion that the new law might be in conflict with California Public Records Act provisions that require release of documents when they are requested. To me this seems a stretch because if things are confidential, they are immune from the Act…
There has been an ongoing criminal investigation into the California Public Utilities Commission for almost two years now over some of the commission members’ backchannel dealings with utility executives. Someone is protecting these miscreants, it seems…
Some food for thought: Our governor may not want people mucking around too deeply into issues involving utilities and energy policy in the Golden State and how licensing of energy projects is carried out. I also have it on the highest authority that last year our governor used his executive power to extract from California’s oil regulating agency maps, geologic surveys and records relating to oil and natural gas reserves beneath his family’s 2,700-acre ranch in Colusa County…

George William Garcelon, whose cowardice and lack of resolve will ever mark him in San Bernardino County’s Hall of Infamy, was born on May 18, 1832 at Oak Bay New Bruswick in Canada. He was the son of Harvey and Charlotte (Sutherland) Garcelon. George Garcelon was raised and educated in New Brunswick.At the age of twenty he went to Lewiston, Maine, where he operated a pharmacy. In Lewiston, he met Mary Frye Tobie, the daughter of Edward Parsons and Caroline (Frye) Tobie. Mary was born in Lewiston in February 1832. George and Mary were married there in 1858 and lived there until about 1872, raising an adopted daughter.
Toward the end of 1872 or early 1873, ill health compelled Mr. Garcelon to seek a more gentle climate and they came west to Riverside, where he settled for the remainder of his life. Here he regained his health and lived to an advanced age. He bought a block of two-and-a-half acres at the head of Seventh Street, between Vine and Mulberry and Sixth and Seventh Streets, besides buying twenty acres on Brockton Avenue. He was one of the most successful fruit growers in Riverside. He built the finest house at that time in Riverside and made that his home for many years. His home was the first lath-and-plastered house in Riverside. In the spring of 1877 the first citrus fair, the parent of the annual citrus fairs that formed one of the advertising features of Riverside was held there. It was in his house in 1887 that the excellent qualities of the navel orange was first tested.
Mr. Garcelon took a very active part in all of the citrus and fruit fairs of Riverside. He went large into lemon growing and encountered the many difficulties that the early settlers encountered in producing a marketable lemon. These difficulties were overcome by Mr. Garcelon and at a later period when he placed his cured lemons on exhibition at a citrus fair in Los Angeles, he won the first premium of $100 for the best exhibit of lemons and $50 for the best box. At the Chicago World’s Fair in 1893 he received a medal and diploma from the manager of the fair for his lemon display. He took an active part in the formation of the Fruit Exchange at the time when the growers were nearly ruined by mismanagement in the marketing of their citrus fruits.
Mr. Garcelon, although not an office seeker, took an active part in public matters concerning the welfare of Riverside. This was unfortunate in that his lack of strength and character left San Bernardino County vulnerable to the forces militating against it. Politically, in the early days when feeling ran high and when the discord arising from the Civil War caused a great conflict between the two old parties, Mr. Garcelon was a staunch Republican and helped materially in turning San Bernardino County Republican. At that time, what is most of what is now known as Riverside County was the lower portion of San Bernardino County. The City of Riverside, before the formation of Riverside County in 1893, formed a very important part of San Bernardino County.
Garcelon was elected Third District Supervisor and served from January 7, 1889 to December 8, 1891, which was less than a full term. His two years in office came during the agitation that resulted in the county division and the founding of Riverside County. This was fomented by an inveterate group of malcontents living in the south end of San Bernardino County.
Garcelon lacked the stomach to stand up to these rebels. Ill-equipped as he was, as a result of considerable dissension among the members of the board of supervisors, both Garcelon and W.H. Glass, the Fifth District supervisor, tendered their resignations from the board. Garcelon was succeeded on January 12, 1892, by Albert S. White of Riverside, the most disloyal and infamous traitor in San Bernardino County history. White would spearhead the final push that sundered Riverside County, or most of it, from San Bernardino County. The following year, lower San Bernardino and a smaller portion of northern San Diego County seceded from their respective counties to form Riverside County. Upon that act of perfidy, White resigned as a San Bernardino County supervisor and became a member of the maiden Riverside County Board of Supervisors.
If Garcelon had been made of sterner stuff, had he some steel in his backbone, he might have been able to bear the pressure put upon him to remain in office and prevent the viper White from entwining his serpentine self about the seat of power in San Bernardino and choking and twisting Riverside County into its fate separate from its rightful position as a part of San Bernardino County, which despite the departure of nearly 7,000 square miles of Riverside County, yet remains as the largest county in the Lower 48 States, a land are of 20,105 square miles, larger than the states of New Jersey, Connecticut, Delaware and Rhode Island combined.
Mr. Garcelon continued to enjoy the success of his citrus ranch until he died on March 9, 1905.
He had been a member of the Board of Trade, and was for many years a member and trustee of the Congregational Church of Riverside. He had joined the Masonic Order in Lewiston, Maine, and was a member of the Riverside Chapter #68, Royal Arch Masons and the Riverside Commandery #28, Knights Templar.

The yellow-breasted chat, known by its scientific name Icteria virens is a bird present in San Bernardino County. It is considered the most atypical member of the New World warbler family and is the only member of the genus Icteria.
Inhabiting dense thickets, scrubby habitats and woodland edges, the yellow-breasted chat is the largest species in the Paruline warblers, with an unmistakable song described as “an astonishingly loud jumble of harsh cackles, rattles, whistles and squeals.” Its call is similarly harsh and grating, sounding something lik “tchak.” The yellow-breasted chat has the lowest pitched voice of any of the warblers, which might be a consequence of its larger size.
Nesting from the southern-plains of Canada and throughout much of the United States to central Mexico during the summer, these birds migrate to lower Mexico and Central America in the winter, with some sporadically overwintering in mild-climated coastal areas.
This species reaches a total length of 6.7 to 7.5 inches and a wingspan of 9.1 to 10.6 inches. Body mass can range from 0.71 to 1.19 ounces. The relatively long, heavy bill is 0.51 to 0.63 inches. The tarsus is 0.98 to 1.22 inches. These birds have olive upperparts with white bellies and bright yellow throats and breasts. Other signature features of yellow-breasted chats are its large white eye-rings and blackish legs.
The yellow-breasted chat is a shy, skulking species of bird, often being only heard but not seen. The breeding habitats of this species are dense, brushy areas and hedgerows. The nests of these birds are bulky cups made of grasses, leaves, strips of bark, stems of weeds and lined with finer grasses, wiry plant stems, pine needles and sometimes roots and hair.
Yellow-breasted chats are ominvorous birds, and forage in dense vegetation. Mostly, this species feeds on insects and berries, including blackberries and wild grapes. Insects of up to moderate sizes, including grasshoppers, bugs, beetles, weevils, bees, wasps, tent caterpillars, ants, moths and mayflies, are typically predated and will be gleaned from dense vegetation.
These birds are not as monogamous as other warblers. In one study in central Kentucky, DNA fingerprinting revealed that 17% of 29 yellow-breasted chat nestlings were not sired by the male of the social pair and 33% of 9 broods contained at least 1 extra-pair nestling.

It’s cooling down and suddenly everything is turning into early autumn. What is eye catching to me lately in the atmosphere of fashion is the black clothes. People can’t wait for the color to pop up, but first things first. Black is an amazing neutral, and I can speak for many. I could live in this color every day of the year. If it didn’t get so hot out here we would all be happy in black. The message is not all black either there are hints of white popping up paired with black. It’s also neat to mix black with a hint of white. The graphics of black and white are really fantastic! But primarily black because the color black has always represented a lifestyle. Fashion is happening so fast, and it really is looking bolder, and bolder than in the past. Stay tuned for more autumn, until next week!

Even as questions were emerging about the psychological abuse of prisoners within San Bernardino County’s jails, the San Bernardino County Board of Supervisors last month increased by $14.2 million the contract the Liberty Healthcare Corporation will receive for providing mental health services in the county’s detention facilities.
The increase was made despite recurrent reports of inadequate care being provided to county inmates with mental issues, evaluations that conform with the interests of the county’s jailors rather than the inmates in need of psychological or psychiatric care and suggestions of kickbacks to county sheriff’s personnel and county officials in exchange for sustaining what has now become for Liberty a highly lucrative contractual arrangement.
San Bernardino County and its sheriff’s department originally contracted with Liberty Healthcare while Orange County-based psychiatrist Thomas C. Lester M.D., who was then doing business as Liberty Healthcare of California, Inc., held the professional license under which those psychiatric services were provided. Lester, however, has ended his relationship with Liberty Healthcare for reasons that have not been made publicly clear. His successor at Liberty is not a psychiatrist but rather a licensed clinical social worker.
It now appears that an eight figure revenue stream into the county for the pass-through of psychiatric evaluation services to jurisdictions throughout the state has blinded county officials to how indigenous county inmates in the sheriff’s jail system are having their psychiatric needs neglected or are the victims of both physical and psychological abuse by their jailers that is being ignored by the mental health professionals Liberty employs. In some cases it is apparent that the mental health professionals employed by Liberty have allowed their function to be compromised such that they have allowed their authority to dispense psychoactive drugs to become a tool in the panoply of methods used by deputies working the jails to perpetuate the abuse of the inmates.
The matter is exacerbated by the consideration that the county’s soon-to-be-departing director of behavioral health has failed to exercise any oversight of the mental health treatment of San Bernardino County citizens housed in the sheriff’s jails and detention facilities.
When Lester and Liberty first obtained what was a relatively modest contract with the County of San Bernardino in 2010 under the auspices of an experimental “pilot program,” competitive bids were bypassed. Subsequently, that contract was renewed without any competitive bidding, and the pilot program has now become an institution at the West Valley Detention Center in Rancho Cucamonga.
While the first contract Lester’s company landed with the county for the three-year period between July 1, 2010 to June 30, 2013 specified a not-to-exceed $499,977 annual cost, not including the cost of medication, in April of 2015, when that no-bid contract was renewed for the period from June 1, 2015 to May 31, 2016, it had zoomed to more than nine times the original cost, $4,756,536.
Last month, Liberty came in for an even more substantial windfall.
On August 23, the San Bernardino County Board of Supervisors voted unanimously to approve an amended contract with Liberty “for comprehensive mental health and programming services in the county’s correctional facilities.”
According to a joint staff report to the board of supervisors dated August 23, 2016 from sheriff John McMahon and CaSonya Thomas, the director of the county’s behavioral health department, the $4.75 million annual contract with Liberty approved last year had been jettisoned in January, in favor of a newly configured one that did not run concurrent with the standard governmental fiscal year running from July to June but rather from the middle of the second week of January 2016 through the middle of the second week of January 2017. That contract imposed a substantial – $1.75 million annual – reduction. But less than eight months into that arrangement, they recommended that the contract be upped.
“On January 12, 2016, the board of supervisors approved Contract No. 16-08 with Liberty Healthcare Corporation to provide comprehensive correctional mental health and programming services to supplement and enhance related services being provided by the department of behavioral health,” the McMahon/Thomas report states. “The initial contract term was January 12, 2016 through January 11, 2017, and included two one-year options to extend the term for a maximum three-year period. In an ongoing effort between the sheriff and department of behavioral health to ensure the quality and effectiveness of mental health services being provided to the county’s inmates, the departments mutually recommend that Liberty assume a greater responsibility for correctional mental health care while inmates are in custody. The department of behavioral health will continue to provide transitional care services for inmates upon release.”
The contract amount was increased by $14,161,308, from $3,047,314 to $17,208,622, and was altered from a one-year contract term to a three-year term, for a new total contract period of January 12, 2016 to January 11, 2019. Thus, the annual value of the contract will jump from $3,047,314 to $5,736,207.33.
According to the report, the number of Liberty staff will increase at the jails. While there will be no change with regard to the single chief psychiatrist in place at the jails and the two mental health registered nurses employed therein, the number of psychiatrists will increase from 4.75 working full-time to 6.75 working full-time; the number of licensed clinical supervisors will jump from one to two; the seven master’s level clinicians will increase to 12; an office assistant will be hired; and the sheriff’s department will hire a supervising correctional nurse to augment the function. Overall, the number of mental health professionals has now seen an increase from 13 to 25.75.
There is a lack of clarity as to what Liberty’s employees’ function actually is and whether the team members are in the county’s jails to facilitate the fulfillment of the Hippocratic Oath – the commitment by doctors and medical professionals to do no harm and help their patients – or whether they are to assist the sheriff’s department and the district attorney’s office in carrying out their missions, which are to obtain convictions against those who have been apprehended and charged criminally.
County and sheriff’s department officials have acknowledged that a major portion of the work carried out by Lester and his employees consists of mental competency restoration services for inmates. A percentage of individuals arrested and incarcerated and slated for trial move into an area of legal limbo after a court determines they are incompetent to stand trial. Once a trial court makes such a determination with regard to a defendant and orders the defendant committed to a state mental hospital for care and treatment to restore competence in order to be processed through the justice system, the state mental hospital has 90 days to make a written report to the court concerning the defendant’s progress toward recovery of mental competence.
But because of chronic shortages of beds within California State Hospitals which have created lengthy waiting lists of inmates in county jails, including those in San Bernardino County, who are in need of mental competency restoration services, the state of California created economic incentives to promote the mental competency restoration concept. This has led to some questionable actions by governmental entities and psychiatric professionals in the scramble for the money. As part of an effort to clear the county’s jails of this backlog of inmates awaiting admission to the state mental hospital system, the county in 2010 hit upon the idea of bringing in a psychiatrist who would provide to those inmates in the county jail the same services those inmates would receive in a state mental hospital. It was at that point that Lester and Liberty entered the picture. In May of 2010, the California Department of Mental Health contracted with Liberty (State Agreement No. 09-79156-000) to establish a pilot program to provide restoration of mental competency services in a county jail. On June 22, 2010, the board of supervisors approved a revenue agreement with Liberty to allow West Valley Detention Center to be used as a site for a state pilot program to provide restoration of mental competency services to county inmates. The San Bernardino County Sheriff’s department allocated 20 beds in a sheltered housing unit for use by Liberty and assigned a deputy to provide security for Liberty’s staff.
San Bernardino County likewise has a financial interest in the program. By utilizing a psychiatrist to provide mental competency restoration services to inmates deemed to be mentally incompetent within the jail setting as opposed to transferring them to a state mental hospital, the county stood to obtain reimbursements from the state. San Bernardino upped the stakes, agreeing to accept inmates from other jurisdictions – all 57 of the state’s other counties – who would be evaluated by Lester and his staff with an eye toward certifying those people to be ready to go to trial. In Fiscal 2015-16 alone, San Bernardino was angling to obtain a reimbursement of $10,857,697.44 from the state for that use of its detention center space.
With this emphasis on monetizing Lester and Liberty’s services, an arrangement that was delivering cold cash into the county’s coffers and Lester and Liberty’s bank accounts, concern arose that the legitimate psychological care of inmates was being overlooked.
This is because, in addition to providing the mental competency restoration treatment, Liberty is also contracted to tend to the psychological needs of the general inmate population. Many see a potential or actual conflict of interest between those two functions. While the mental competency restoration treatment of inmates transplanted into San Bernardino County jails and detention facilities represents an influx of income to the county, the provision of psychiatric care to the county’s general inmate population does not. In such an environment, when there is a shortage of psychiatric care assets they end up being apportioned overwhelmingly away from San Bernardino County citizens.
Moreover, reports have reached the Sentinel of the abuse of jail inmates, including what might be defined as mental and emotional abuse – intended to “psychologically break” the inmates, at least some of whom maintain they are innocent of the crimes they are charged with and form the basis of their incarceration.
In one case, that of Kristen Arthur, after Judge Charles Umeda ordered that she be granted a session with a jail psychiatrist, her jailors refused for more than six hours to bring her out of solitary confinement so she could be seen by Dr. Patricia Kirkish, a psychiatrist who had travelled from her office in Pasadena to West Valley Detention Center to evaluate Arthur and her condition. After the interminable wait and no indication that access to Arthur would be granted, Kirkish departed without seeing her.
In this way, it appears the psychological health of certain inmates is not being tended to. This is most likely to occur, the Sentinel is informed, when sheriff’s department or jailhouse personnel have a particular animus toward the inmate in question or the inmate has been the victim of physical or psychological abuse by sheriff’s deputies which may have triggered behavioral issues with the inmate. Given the power relationship that exists between the sheriff’s department, its administrators and personnel vis-à-vis Liberty and its mental health professionals, taken together with the lucrative nature of Liberty’s contract, the willingness of Liberty’s employees to stand up for the inmates it is their responsibility to treat has been compromised.
More troubling still is the sheriff’s department’s use of psychoactive drugs to render the inmate population within the jail system manageable, and Liberty’s acquiescence in this practice. Jailors dole out a host of psychoactive drugs to inmates, including sedatives, tranquilizers or anti-psychotic agents.
The inmates commonly refer to these drugs as Skittles, because of their coloration and visual similarity to the fruit-flavored candy produced by the William Wrigley, Jr. Candy Company. Not all of the inmates are amenable to being administered these drugs, which leave those taking them in a zombie-like or near catatonic state.
One former inmate at West Valley Detention facility told the Sentinel of his experience.
“I had been jailed after getting two driving under the influence tickets within a relatively short time,” he said. “I had been playing the fool and after my incarceration I arrived at the conclusion that I was going to get my life together. I was going to get sober and remain so. I resolved that I would use the time I was going to be in jail to get started on that. One day, something like two months after I had been in continuous custody, I awoke from a bad dream, cursing, and another inmate, who thought I was cursing at him, tried to get violent with me. Fortunately, cooler heads prevailed and no actual fight took place. Shortly after that, I was called out to talk to a psychiatrist and later that evening I was given Thorazine. That evening, a deputy, who was with a medical officer, called my name. The medical distributor, a woman, tried to hand me the medication. I declined it. At that point, the deputy told me in a loud enough projection of his voice to be overheard by all 47 inmates in the dormitory that if I did not take the Thorazine, privileges for all of us – phone access, day room, yard access, and television – would be revoked indefinitely. At that point, I would say ten or fifteen of the inmates made threats of violence toward me. Several of the others were mocking me, saying, ‘Take your skittles.’ So, I did.”
The former inmate told the Sentinel that he reluctantly complied with taking the Thorazine for roughly the next two weeks.
He said the drug left “me basically in a tongue-tied, slobbering, invalid state.”
As his date for release approached, he was advised by another inmate that he would be taken off the Thorazine “cold turkey,” which would very likely leave him incapable of maintaining sobriety. At that point, he declined taking any more Thorazine. He said a deputy, “tried the same scare tactic of revoking the entire dormitory’s privileges if I stuck with” his refusal. “I turned to the rest of the tank and told them, ‘If anyone has a problem, step down right now and we will go toe-to-toe.’ The deputy, who recognized at that point he would have a major problem on his hands, moved on without forcing me to take the medication.”
Later that evening, he was called out for a phone interview with a psychologist, who, he said “asked me why I was refusing to take my meds. When I told her the entire story, she looked into the situation and got back to me about a week later, saying she had looked into my psychiatric case file and she found no notes in there warranting any medication at all.”
The Sentinel approached Dr. Lester. He was unwilling to make any statements about whether he and Liberty had facilitated the sheriff’s department’s use of psychoactive drugs to control inmates or what standards or protocols are in place with regard to determining if inmates should be medicated. Nor was he willing to discuss whether he considered Liberty’s dual contracts for restoration of competency and psychiatric care to be in conflict with one another. Nor would he discuss if there was a strict separation of functions involving different Liberty personnel to supply the evaluations and other personnel to provide the inmate psychiatric care to ward off any such conflicts.
“I don’t know how they are doing things there now,” he said. “I haven’t been there in nine months. Liberty needs to address these things you are asking about, or the sheriff’s department, or both of them.”
Lester did not explain why he was no longer working for Liberty or with the San Bernardino County Sheriff’s Department.
“You should talk to Kevin Rice,” he said. “He’s in charge of what Liberty is doing at West Valley now.”
When the Sentinel contacted Rice, he did not dispute that the sheriff’s department was utilizing tranquilizers or anti-psychotic drugs to render the jail population manageable, but said, “Medication cannot be provided to an inmate without a doctor’s order. Under no circumstances would drugs be provided without a doctor’s assessment. That is standard anywhere. You can’t give medications to anyone without a doctor’s order.”
Asked whether he perceived some order of conflict in Liberty providing both the restoration of competency services and psychiatric care to the inmates in the same detention facilities and if there was some separation of duties that would ward off such a conflict, Rice said, “I can’t answer specifically how the services are provided.”
He gave a somewhat ambiguous response when asked if the county department of behavioral health exercised some oversight over the provision of psychological and psychiatric services provided to inmates in the county’s jail system. “The sheriff’s department has always been in charge of mental health programs in the jails,” he said. The Sentinel reposed the question, asking if the department of behavioral health monitored the delivery of the services. “Ultimately, mental health services is the responsibility of and under the authority of the sheriff’s department,” Rice said.
Rice, a licensed clinical social worker, shied away from explaining how he was able to replace Lester, a licensed psychiatrist, in overseeing Liberty’s psychiatric care and restoration of competency operations at West Valley.
“Those decisions are made at a higher level, way beyond me,” he said. “You need to speak to someone who is part of those decisions.”
When the Sentinel asked whether the sheriff’s department passes along to the department of behavioral health the records and authorizations relating to the dispensing of sedatives, tranquilizers and anti-psychotics to jail inmates, Rice moved to shut the interview down. “There’s not a whole lot I can answer,” he said. “I don’t have the authority to speak on behalf of the sheriff’s department regardless of which direction it is going. It is not appropriate for me to say anything. You should speak with Terry Fillman, the sheriff’s department’s medical services administrator.”
The Sentinel was unable to obtain a substantive response from Fillman. When reached by phone at his office at West Valley Detention Center he declined to explain on what basis the deputies working the jails could prevent an inmate from being interviewed by a psychiatrist after a judge had ordered that such a session with a psychiatrist take place. He refused to entertain any further questions, lawyering up in the process. He said the Sentinel should provide the questions it has in writing to sheriff’s department spokeswoman Jody Miller.
“She’ll give you that information once she is authorized to do so by county counsel,” Fillman said.
The office of county counsel is the county’s stable of in-house attorneys.
In attempting to reach CaSonya Thomas, the director of the county’s behavioral services department, the Sentinel was diverted to both the county’s main spokesman, David Wert, and the department of behavioral services’ public information officer, Aimara Freeman.
Freeman asked for questions to Thomas to be submitted in writing. Accordingly, the Sentinel inquired as to:
• Whether Thomas sees a potential or actual conflict between Liberty’s competency restoration and psychiatric care functions;
• If Thomas was sensitive to the consideration that the mercenary motive of running psychiatric evaluations of inmates originating from outside the county and the revenue the county receives from the state for providing that service may have compromised the psychiatric care provided to the inmates in the county’s jails;
• If Thomas was aware of the sheriff’s department using sedatives, tranquilizers and anti-psychotics to render elements of the jail population more manageable;
• If Thomas considered the practice of using sedatives, tranquilizers and anti-psychotics to render elements of the jail population more manageable appropriate;
• What sort of records are kept of medications issued to the county’s jail inmates;
• What the protocol for determining whether a jail inmate should receive sedatives, tranquilizers and anti-psychotics is;
• Whether there are medical or psychiatric authorizations made by licensed medical or psychiatric professionals for the dispensing of sedatives, tranquilizers and anti-psychotics to jail inmates;
• If the sheriff’s department passes along to the department of behavioral health the records and authorizations relating to the dispensing of sedatives, tranquilizers and anti-psychotics to jail inmates;
• If the department of behavioral health had any participation in creating the protocol for determining whether a jail inmate should receive sedatives, tranquilizer and anti-psychotics;
• How many inmates in the county’s jails at present are receiving sedatives, tranquilizers or anti-psychotics; and
• If Thomas has monitored Liberty’s function with regard to the services it is providing in the jail system.
Freeman was unwilling to provide substantive answers to any of the questions. She offered a curt, two sentence reply. “The department of behavioral health has no authority over the provision of jail mental health services or the contract with Liberty,” she said. “Please direct your questions to the sheriff’s department.”
The Sentinel followed up with a single question, inquiring how it was that Freeman had co-authored the report to the board of supervisors relating to its August 23 vote for increasing Liberty’s contract scope at the jails if she had no authority over mental health services at the jail. Freeman did not respond.
The Sentinel redirected the written questions provided to Freeman to sheriff’s department spokeswoman Jody Miller, who on Wednesday said she would respond if the questions were provided in that form. By press time, Miller had not responded in writing or verbally to any of those questions.
Wert told the Sentinel, “The department of behavioral health is recognized nationally for the extraordinarily high level of care it provides to its clients in San Bernardino County. However, to ensure client privacy, the department does not discuss the specific care it provides. Additionally, the department has no role in the management of the county’s jails.”
The Sentinel has learned that Thomas is not a licensed psychiatrist or psychologist, despite her status as the head of the county’s behavioral services division. Rather, she is an administrator, with a master’s degree in business administration. She does possess a certificate in health care compliance.
The board of supervisors has voted to remove Thomas as the director of the behavioral services division and “kick her upstairs” to become the county’s human services director in mid-October.

FONTANA–An increasing number of Fontana Unified School District students met or exceeded standards on California’s Smarter Balanced tests for English language arts (ELA) and mathematics, according to district officials and data released Wednesday by the state Department of Education.
The data from the second-year, computer-based tests – administered to students in grades three through eight, and grade 11 – show progress in student performance and achievement levels on the more rigorous California Standards, which are in their third year of implementation and challenge students to apply the knowledge and skills they are learning in the classroom to real-world problems.
The 2016 state test scores show that FUSD students improved their mathematics and English language arts/literacy performance over last year, with students meeting or exceeding state standards rising to 33 from 28 percent in ELA and to 19 percent from 17 percent in mathematics.
“We are seeing growth in student achievement levels across the board and are incredibly proud of the hard work our teachers and staff have put forward to ensure our students are a receiving a high-quality education that will transfer to the real world,” Fontana Unified Board President Lorena Corona said. “While we know there are areas in which we can improve, our District is confident that the positive gains this year are a reflection of what’s to come.”
