Hummingbirds

Hummingbirds are New World birds of the the family Trochilidae. They are among the smallest of birds, with some no more than three inches in length, and the largest measuring at roughly five inches. The smallest extant bird species is the one-and-one-third inch long bee hummingbird,which weighs less than 2.5 grams.
Hovering in midair through high speed wing-flapping featuring nearly fifty strokes per second, they make a humming sound audible to humans. They are capable of flying as fast as 35 miles per hour, both frontwards and backwards. They have extremely high metabolisms, such that with the exception of insects, hummingbirds while in flight have the highest metabolism of all animals, a necessity to support the rapid beating of their wings during hovering and fast forward flight. Their heart rate can reach as high as 1,260 beats per minute, with a breathing rate of 250 breaths per minute. During flight, oxygen consumption per gram of muscle tissue in a hummingbird is about 10 times higher than that seen for elite human athletes. Hummingbirds, which are continuously hours away from starving to death, consume more than their own weight in nectar each day, and to do so they must visit hundreds of flowers. They can make use of ingested sugars to fuel hovering flight within 30–45 minutes of consumption, oxidizing sugar in flight muscles rapidly and reserving their limited fat stores to sustain them overnight or to power migratory flights.
The dynamic range of metabolic rates in hummingbirds requires them to have superpowerful kidney function that can be slowed or stopped when it is undergoing water deprivation, a physiological mechanism unique to hummingbirds.
Prior to nonstop flight across hundreds of miles during migration, a hummingbird will store fat as a fuel reserve, doubling its weight by as much as 100 percent, increasing potential flying time over open water.
Hummingbirds are capable of conserving energy when inactive or not foraging for food by going into torpor, a hibernation-like, deep sleep state known as torpor needed to prevent energy reserves from falling to a critical level. During night-time torpor, body temperature falls from 104 degrees Fahrenheit to 40 to 154 degrees Fahrenheit, with heart and breathing rates both slowed dramatically. Body mass declines throughout nocturnal torpor, amounting to about 10% of weight loss each night. Their hormone, corticosterone, is one signal that arouses a hummingbird from torpor.
There are 338 recognized species of hummingbirds, which fall into nine main clades, the Topazes, Hermits, Mangoes, Brilliants, Coquettes, Patagona, Mountain Gems, Bees, and Emeralds, defining their relationship to nectar-bearing flowering plants and the birds’ continued spread into new geographic areas.
All hummingbirds depend on flower nectar to fuel their high metabolisms and hovering flight. The various species have made evolutionary adaptations to coordinate bill shape to flower shape. Hummingbirds appear to have originally evolved from from insectivorous swifts (family Apodidae) and treeswifts (family Hemiprocnidae) about 42 million years ago, based in part due to a key adaptative mutation of an altered taste receptor that enabled hummingbirds to seek nectar.
In traditional taxonomy, hummingbirds are placed in the order Apodiformes, which also contains the swifts. However, some taxonomists have separated them into their own order, the Trochiliformes. Hummingbirds’ wing bones are hollow and fragile, making fossilization difficult and leaving their evolutionary history poorly documented. Most, but not all, scientists theorize that hummingbirds originated in South America. Hummingbirds exhibit gender dimorphism, in which males are smaller than females in small species, and males are larger than females in large-bodied species. The extent of this sexual size difference varies among clades of hummingbirds. In some clades males and females are similarly sized. In many clades, females have longer, more curved beaks favored for accessing nectar from tall flowers.
Sexual size and beak differences likely evolved due to constraints imposed by courtship because mating displays of male hummingbirds require complex aerial maneuvers and are costly in terms of energy. Males tend to be smaller than females, allowing conservation of energy to forage competitively and participate more frequently in courtship. Thus, sexual selection will favor smaller male hummingbirds. To augment courtship, many male hummingbirds have plumage with bright, varied coloration. By merely shifting position, feather regions of a muted-looking bird can instantly become fiery red or vivid green. The outer tail feathers of male Anna’s hummingbird (Calypte anna) vibrate during courtship display dives and produce a loud chirp. When courting, the male ascends some 35 meters before diving over an interested female at a speed of 88 feet per second, equal to 385 body lengths/second, producing a high-pitched sound. This downward acceleration during a courting dive is the highest reported for any vertebrate undergoing a voluntary aerial maneuver, resulting in gravitational forces, the level of which equals or exceeds the g-force acceleration that causes near loss of consciousness in fighter pilots during flight of fixed-wing aircraft in a high-speed banked turn.
Hummingbirds can sing at the same frequency as the tail feather chirp, but its small syrinx is not capable of the same volume. The sound is caused by the aerodynamics of rapid air flow past tail feathers, causing them to flutter in a vibration which produces the high-pitched sound of a courtship dive.
Female hummingbirds tend to be larger, requiring more energy, and their beaks longer to access preferred flowers. Female hummingbirds tend to have longer beaks that allow for more effective reach into crevices of tall flowers for nectar. Thus females are better at foraging, acquiring flower nectar, and supporting the energy demands of their larger body size.
Female hummingbirds construct small cup-shaped nests on the branch of a tree or shrub, often using spider silk and lichens to bind the nest material together and secure the structure. Use of silk allows the nest to expand as the young hummingbirds grow. Two white eggs are laid and incubation lasts 14 to 23 days, depending on the species, ambient temperature, and female attentiveness to the nest.The mother feeds her nestlings on small arthropods and nectar by inserting her bill into the open mouth of a nestling, and then regurgitating the food into its crop.
Hummingbird flight has been studied intensively from an aerodynamic perspective using wind tunnels and high-speed video cameras. The birds produce 75% of their weight support during the downstroke and 25% during the upstroke, with the wings making a “figure 8” motion. Hummingbird hovering has been estimated to be 20% more efficient than performed by a helicopter drone.
Male rufous and broad-tailed hummingbirds (genus Selasphorus) have a distinctive wing feature during normal flight that sounds like jingling or a buzzing shrill whistle. The trill arises from air rushing through slots created by the tapered tips of the ninth and tenth primary wing feathers, creating a sound loud enough to be detected by female or competitive male hummingbirds and researchers up to 300 feet away.
Behaviorally, the whistle serves several purposes, including announcing the gender and presence of a male bird, providing audible aggressive defense of feeding territory and an intrusion tactic, enhancing the alerting of a threat, and favoring mate attraction and courtship.
Hummingbirds are specialized nectarivores and are tied to the ornithophilous flowers upon which they feed. Like bees, they are able to assess the amount of sugar in the nectar they eat; they normally reject flower types that produce nectar that is less than 10% sugar and prefer those whose sugar content is higher. Nectar is a mixture of glucose, fructose, and sucrose, and is a poor source of nutrients, so hummingbirds meet their needs for protein, amino acids, vitamins, minerals, etc. by preying on insects and spiders.
Hummingbirds tend to be interested in flowers of a color wavelength ignored by nectar interested insects, which thereby reduces nectar robbing. Hummingbird-pollinated flowers also produce relatively weak nectar (averaging 25% sugars w/w) containing a high proportion of sucrose, whereas insect-pollinated flowers typically produce more concentrated nectars dominated by fructose and glucose. Hummingbirds eat many small meals and drink with their tongues by rapidly lapping nectar. Their tongues have tubes which run down their lengths and help the hummingbirds drink the nectar.
Hummingbirds are restricted to the Americas from south central Alaska to Tierra del Fuego, including the Caribbean.
Most hummingbirds of the U.S. and Canada migrate southward in fall to spend winter in Mexico, the Caribbean Islands, or Central America. A few southern South American species also move north to the tropics during the southern winter. A few species are year-round residents of California and southwestern desert regions of the USA. Among these are Anna’s hummingbird, a common resident from southern Arizona and inland California.

It’s gold out there because the holiday season is sparkling everywhere. This is the neatest weather because it’s getting cold in San Bernardino County. To boot, the colorful moment is in the shades of gold. The spirits are lifting because of the lovely gold being reflected in what people are wearing out there. There are golden tops, dresses, sweaters, and shoes. A new variation of gold has  also hit the streets and it’s called rose gold. This so-called rose gold looks magnificent with black, red, green, and even pink. It’s all about creativity on the streets of California and this is really what makes us unique in the Golden State. It can get colder and then suddenly warm again, which offers more opportunity for creativity. With that said, dress up, warm up, and start dashing through the winter season. Until next week, here’s to new beginnings that come with the golden magical holiday season.

Second Upland Marijuana Dispensary Permitting Initiative Petition Fails

Proponents of a follow-on medical marijuana clinic permitting petition failed to meet the December 7 deadline for filing with the Upland City Clerk sufficient signature endorsements to qualify an initiative that would have forced the city to hold a special election sometime in Spring 2016.
The same group, bankrolled by wealthy strip club owner Randy Welty, working with the California Cannabis Coalition qualified a similar proposal last year. But the city thwarted the California Cannabis Coalition’s goal of having the matter decided during a special off-year election on technical grounds. Instead, the city and its lawyers last spring succeeded in persuading a San Bernardino Superior Court judge that the election would need to be consolidated with the general election in November 2016. That court ruling prompted the second and most recent signature-gathering effort.
In October 2014, a group of Upland residents, nominally headed by Nicole DeLaRosa and James Velez, and sponsored by the California Cannabis Coalition, Craig Beresh and Randy Welty, undertook a petition drive to qualify for the ballot in Upland an initiative aimed at overturning Upland’s ban on marijuana dispensaries. Beresh is the California Cannabis Coalition’s president. Welty, a coalition board member, has an ownership interest in 53 medical marijuana clinics throughout the state and owns Upland’s Tropical Lei nightclub, Upland’s Toybox adult bookstore, other adult bookstores located elsewhere, and at least four other strip clubs.
On January 14, 2015 Beresh and Welty on behalf of the California Cannabis Coalition and others involved in the signature-gathering effort came to Upland City Hall and handed over to then-Upland administrative services director/city clerk Stephanie Mendenahll an initiative petition endorsed with 6,865 signatures later determined to be valid gathered in Upland. Per state law, an initiative petition that garners the valid signature endorsements of ten percent of the voters within a particular jurisdiction must be put on the ballot at the next regularly scheduled election in that jurisdiction. An initiative petition that garners the signed endorsement of 15 percent or more of the voters in a particular jurisdiction requires that the initiative be put on a specially-scheduled ballot within that jurisdiction not more than 105 days after the petition is accepted as valid by the board overseeing that governmental  jurisdiction. That governmental entity must bear the cost of that special election. The 6,865 signatures gathered by the petitioners represented more than 15 percent of the registered voters in Upland. Thus, the Cannabis Coalition, represented by its attorney, Roger Diamond, asserted that the city was obliged to put the initiative before the voters no later than June 23, 2015, the first Tuesday after the elapsing of 105 days from the time the Upland City Council on March 9 officially acknowledged that the 6,865 signatures on the petition were valid.
Three members of the council, however, consisting of mayor Ray Musser, councilman Glenn Bozar and councilwoman Carol Timm, were adamantly opposed to reversing the city’s current ordinance, which bans cannabis clinics from operating anywhere in the city. Taking his cue from that troika’s political sentiment, city attorney Richard Adams researched the issue and brought forth a theory by which he asserted the city could postpone the election until the next regularly scheduled municipal election in November 2016.
The initiative imposes a set of limitations on the dispensaries and a protocol for their application and licensing. Under the terms of the initiative, the number of dispensaries in the city would be limited to three and they would have to be located within the relatively confined north side of Foothill Boulevard, south of Cable Airport, and between Airport Drive to the east and Monte Vista to the west. Each of the applicants for the three dispensaries would have to pay a $75,000 nonrefundable licensing fee intended, the initiative’s sponsors asserted, to cover the city’s costs in carrying out background checks and making other inquiries and efforts to process the applications and patrol the dispensaries once they were up and running.
Referencing the $75,000 licensing fee, Adams and his assistant, deputy city attorney James Touchstone, asserted that if a governmental fee exceeds the cost of providing services, licensing and inspection, it is not a fee but a tax and that, according to the California Constitution, a vote on a tax cannot be held in the venue of a special ballot but must be held during a regularly scheduled election.
The timing of the election was considered significant for two reasons. The first was cost. The county registrar of voters would charge the city somewhere between $75,000 and $180,000 to handle the election as a stand-alone June 2015 event. The city stood to reap considerable savings by putting the election on the November 2016 ballot, when the mayor’s post, a single city council position and city treasurer spot are up for reelection. Secondly, advocates of the initiative saw a special election as the forum in which sale of medical marijuana within the city limits of Upland is most likely to gain acceptance of the voters participating. Informal surveys of Upland voters show that, on balance, the city’s residents are against the initiative. But special elections normally have poor voter turnout and the initiative’s advocates believed that through the aggressive and energetic use of social media and networking among that portion of the city’s electorate most favorably inclined toward the accessibility to medical marijuana and marijuana use in general, they could drive enough voters to the polls to prevail in a special election while a significant portion of the city population opposed to the concept of open access to marijuana might fail to participate.
Diamond, on behalf of the sponsors of the initiative, filed a lawsuit on March 19 accompanied by a peremptory writ in which it was asserted the city had denied “the signers of the initiative…the full benefit of California law, which requires that the initiative be put on the ballot within 88 to 105 days of the certification of the signatures.”
The matter came before Judge David Cohn, who wrung from both sides an agreement to let him decide the matter as a bench trial without a jury. Cohn then pressed Diamond to deconstruct the city’s primary defense for waiting until 2016 to hold the election, which consisted of its representation of the fee as a tax. Cohn asked Diamond to identify in a series of the city’s legal submissions evidence to controvert the city’s assertion that the $75,000 fee is a tax. In his responses, Diamond took aim at the city’s claim that the background checks, licensing processing, follow-up inspections and investigations would at most cost $56,540 and that enforcement and prosecutions of violations would run no more than another $10,000. Diamond asserted that the city had “artificially” minimized the cost and that while the exact costs could not be quantified ahead of time, the $75,000 fee was a reasonable one intended to cover the city’s outlays in accommodating the uses envisioned in the initiative. “You cannot come up with an exact mathematical figure when you are talking about a future event,” he said. “They [the city] can set any cost they want.”
Touchstone retorted that the total itemized costs of $66,540 was under the $75,000 specified in the initiative.
When the Cannabis Coalition’s attorney, Diamond, failed to satisfactorily convince him that the fee does not rise to the level of a tax, Cohn ruled against the Cannabis Coalition and in favor of the city. “Saying ‘This is clearly a fee,’ doesn’t make it a fee,” Cohn said. “I wasn’t able to find anything that stated $75,000 was a reasonable cost,” Cohn said. “The city has an affirmative obligation not to place a measure on the ballot it believes is unconstitutional.”
At that point, Welty and Beresh headed back to square one and in June 2015 took up a second petition drive, this time one in favor of a marijuana clinic-permitting initiative that omitted the provision for the $75,000 fee. They had until December 7 to obtain the requisite signatures to force the issue onto the ballot. Armed with the valid signatures, names and addresses of the 6,865 voters who endorsed the first petition turned in to the city clerk in January, Welty and Beresh appeared poised to be able to go directly to those voters and reproduce the success they had earlier achieved. Accompanying the second petition drive were threats that emanated from their camp that they would also seek the recall of members of the council who had opposed their first effort.
At a council meeting he attended in August 2015, Beresh told the Sentinel his group had gathered what was nearly a sufficient number of signatures to qualify the initiative for the ballot. He said that his group was trying to make a determination as to what the most advantageous timing would be with regard to turning the petitions over to the city clerk.
Then, in September 2015, Hal Tanner, a former assistant warden in the California Prison System who lives in Upland, served Mayor Musser with recall papers, beginning a petition drive to remove him from office. It was unclear whether Tanner was in any way affiliated with Welty and Beresh, but the recall effort he led appeared to be a fulfillment of one of Beresh and Welty’s recall threats. Tanner subsequently denied being involved with the marijuana dispensary legalization effort. No recall effort against Bozar or Timm accompanied the one targeting Musser.
Meanwhile, a group, Upland Parents Against Drugs, led by Jackie Nutting and Pat Almazan, undertook a grassroots effort to thwart the signature gathering effort by the California Cannabis Coalition. They shooed and shamed signature gatherers from public locations where the petition gatherers for the first initiative had previously experienced success, such as grocery store and shopping center parking lots. They devised a handbill entitled “Bad Medicine For Upland” which called upon Upland residents to eschew the petition and they made a concentrated effort to distribute the flyer to registered voters throughout the city, particularly those who had signed the first petition.
A confluence of factors – including the efforts by Upland Parents Against Drugs and a backlash related to the recall effort against Musser, as well as Welty’s failure to infuse the signature gathering effort with as much money as he had provided toward the previous effort – resulted in the petition drive coming up short. How short is not known, as the keepers of the petitions are not required to publicly release them. As the D-hour approached, 6 p.m. – when City Hall closes – on December 7, initiative opponents were bracing themselves for what they considered to be the worst. But when City Hall shut its doors that evening, no one representing the California Cannabis Coalition had arrived and the second effort was officially dead.
Efforts to obtain a reaction from Welty were unsuccessful. A call to the Tropical Lei was met by an employee who acknowledged that Welty owned the strip establishment but that “He’s never here, Bro. I never see him. You’ve got to get a hold of him on his cell phone.” He did not provide Welty’s cell phone number.
Jackie Nutting said, “The members of Upland Parents Against Drugs are resolved to fighting the Cannabis Coalition and all others who seek to endanger our children for their own personal gain. The fact that the coalition could not even gather enough signatures to qualify their petition for a special election shows that Upland citizens will act wisely when given the truth.”
Nutting continued, “The members and volunteers of Upland Parents Against Drugs fought diligently with their time and their money in order to win this battle. Again in January we will be reaching out to PTA members and other such groups to begin our fight against the November 2016 ballot initiative in favor of legalizing marijuana dispensaries.”
Almazan told the Sentinel, “I am just happy that smarter, sensible heads prevailed and people realized that pot shops, delivery vans and the cultivation of pot is not right for our community. However, come November 2016, in the general election, Upland residents will have the opportunity to officially vote this issue in or out once and for all. Many dedicated individuals came together and worked hard on this issue. It takes a village and that village came out.”

Christians Wage Jihad For Soul Of The Chino School District

The Chino Valley Unified School District is torn by religious strife, as a group of fundamentalist Christians have attempted, and in some measure succeeded, in taking command of the district. Despite a lawsuit which challenges the religiosity that pervades the district’s schools and its district office, those championing the celebration of Christian ideals, standards and beliefs in a public setting remain unapologetic.
It is no secret that three of the school board’s members – James Na, Andrew Cruz and Sylvia Orozco – are members of the Chino Hills Calvary Chapel, a church led by the Reverend Jack Hibbs, who had successfully lobbied the board previously to include Bible study classes as part of the district’s high school curriculum. Hibbs evinces a denominationalist attitude, which holds that Christians have a duty to take over public office and promote their religious beliefs. In a very real sense, Hibbs’ ability to drive the members of his church to vote and support the candidates of his choosing has had a major impact on the policy of the district.
One of those policies is that of including prayer, i.e., specifically Christian prayer, religious homilies and constant reference to God in the discussions of the school board at its public meetings.
Some parents in the district objected to that practice. Efforts to convince the board members to tone the religious references down failed, resulting in the Freedom From Religion Foundation of Madison, Wisconsin filing suit in Federal Court in Riverside in November 2014 against the district on behalf of two named plaintiffs, Larry Maldonado and Mike Anderson, and 21 unnamed plaintiffs who asserted they were alienated or intimidated at school board meetings because of overt and constant references to Christianity, including “prayers, Bible readings and proselytizing.” In the suit, the plaintiffs are seeking the cessation of religiosity as an element in the district’s conducting of business.
While some district officials suggested the district could have made an early and inexpensive exit from the lawsuit by dispensing with the sermonizing, the board majority elected to make a test case out of the circumstance, and engaged the Sacramento-based Pacific Justice Institute for $1 to defend the district in the civil lawsuit.
The Pacific Justice Institute, founded and led by Brad Dacus, touts itself as a public interest law firm that “handles cases addressing religious freedom, including church and private school rights issues, curtailments to evangelism by the government, harassment because of religious faith, employers attacked for their religious-based policies, [and] students and teachers’ rights to share their faith at public schools.”
According to the Pacific Justice Institute’s website, it stands “at the forefront of attorneys who recognize the need to preserve religious liberty in America.” The institute has sought to make a name for itself by taking on cutting edge religious activity-as-free speech cases which ultimately end up before the U.S. Supreme Court, defending Christian ministering in public as a First Amendment-protected activity, challenging California law giving transgender students access to toilet facilities of their own choosing, opposing the teaching of yoga as an exercise program in public schools, and contesting municipal bans on the display of nativity scenes on public property during the Christmas season.
While Cruz, Na and Orozco have indicated the district can wage the good fight against the Freedom From Religion Foundation and not sustain any costs or liability as a consequence of defending against the suit, others are not so certain. In other religious liberty cases brought under the aegis of the First Amendment, school districts that sought to stand up for prayer in school ended up having to pay in the hundreds of thousands or even millions of dollars after they lost cases, even though they were defended pro bono. After litigating in an effort to teach “intelligent design” in public schools in 2005, the Dover Area School District in Pennsylvania was socked with paying $1 million in legal fees to the prevailing party.
Moreover, there is concern that the district board will squander valuable time and attention on the suit rather than tending to the district’s business at hand, which is educating the district’s students. Those of the Christian and denominationalist orientation, trusting in Divine Providence as they do, have little concern for what the eventual outcome of the court case will be. If the case lingers in court for another two, three, four or even five years, that will suit their agenda, even if they lose, in that during that time they will be free to continue with on-campus and in-district proselytizing until a ruling clearly going against the district is handed down.
Indeed, the prospect for the United States District Court for the Central District of California Eastern Division allowing the intrusion of religion, and Christianity in particular, into the educational process in the fashion that takes place in the 31,992-student Chino Unified School District appears dim, at best. Since 1962, when the U.S. Supreme Court ruled in the case of Engel v. Vitale that school-sponsored prayer in public schools violated the Establishment Clause of the First Amendment, most public schools – with some exceptions – have desisted in engaging in prayer sessions. In the few cases where the matter has come up, the ban on school prayer has been reaffirmed.
In 2014, however, in the matter of Town of Greece v. Galloway, the U.S. Supreme Court as it is currently composed, demonstrated that it is prepared to tolerate some measure of public prayer. In that case, a majority of the Supreme Court held that the recitation of a prayer at town board meetings does not violate the Establishment Clause when “the practice is consistent with the tradition long followed by Congress and state legislatures, the town does not discriminate against minority faiths in determining who may offer a prayer, and the prayer does not coerce participation with non-adherents.”
The Pacific Justice Institute will very likely seek to apply the Town of Greece v. Galloway case to the one it is defending against on behalf of Chino Unified, despite the assertion by the plaintiffs that the praying and proselytizing in Chino is Christian-based and that those who have brought the suit assert that indeed they were being coerced.
The subtleties of what has grown into the current standard with regard to freedom of religion appears to have been lost on some of the principals involved.
Na, for example, habitually celebrates his love of America, Republican values and his Christian faith in both private and public contexts. He genuinely seems to assume with most of his interlocutors that they share his views and attitudes and, ingenuously expresses disapproval akin to being hurtfully disappointed if one does not embrace his leanings, let alone resists his importuning that he or she embrace the gospel of Jesus Christ. He has suggested that it is wrong for anyone to assert that he is the one out of step with what is right and that it is incumbent upon those who disagree with him to change themselves. “Everyone who does not know Jesus Christ, go find him,” he said during a board meeting.
Na’s attitude reflects that of his pastor, Hibbs.
Hibbs calls upon his congregants to be “political activist soldiers in the service of the Lord” and “prayer warriors.”
Hibbs has asserted “No law is going to stop people from praying.” A handbill he authored states, “It has long been the tradition of our nation to open federal, state, and local legislative sessions, as well as town and school board meetings, with an invocation asking God for divine guidance and blessing. People of faith must unite to encourage the school district and its board members to continue their support of this time honored tradition.”
It was during both of Na’s two terms as board president that the religious references during board meetings intensified. As a consequence of this ethos during Na’s second stint as board president, Cruz, who was elected to the school board in 2012, became much more assertive in making his own religious overtures, often layering in Biblical quotations during discussion of routine board items, including passages from Psalm 143:8; 2 Corinthians; 2 Galatians; Romans 15:6; and Galatians 5:22 & 23.
Irene Hernandez-Blair succeeded Na as board president. She is less overtly religious than Na, Cruz and Orozco and appeared to be steering the district toward middle ground on the religion-in-school issue. Under her watch, however, Cruz, at the July 16 board meeting heightened the controversy, holding forth on his views pertaining to inculcating in the district’s charges conservative and Christian values in a rambling 10 minute soliloquy, touching on parentage, race, exemption from school vaccinations and immigration. This created a firestorm of controversy that galvanized many of the plaintiffs in the suit brought by the Freedom From Religion Foundation and animated others who were not involved in the suit, a number of whom called upon Cruz to resign. These critics also importuned the board to refrain from electing Cruz, who was board vice chair under Hernandez-Blair, as the new board president upon the sunsetting of Henandez-Blair’s term as president this month. The Chino Unified School District Board has a tradition of elevating the board vice president to president.
Whether the board would adhere to that call to keep Cruz from being given the school board president honor was seen as a test between the pro-religious contingent and those advocating keeping prayer and religion out of Chino’s public schools. In October, a sign of which was in ascendancy came when Hernandez-Blair, indicating she was facing threatened “reprisals” by remaining as board chair, declared she would resign as board chairman, effective immediately. She did not spell out what reprisals were aimed her way, but it was generally assumed that she was being targeted by those who disapproved of her unwillingness to stand up for keeping God in the classroom. Cruz was elevated by his colleagues to serve as acting/interim president at that time.
Last night, on December 10, as part of the board’s normally scheduled reorganization, Cruz was officially given the position of board president, Orozco was elevated to the position of board vice president and Pamela Feix was installed as board clerk.

Chambers Of Commerce See Roles As Business Advocates Quelled By City Subsidies

A crisis of purpose, justification and effectiveness has gripped a number of San Bernardino County’s local chambers of commerce, decades after the traditional function of the once-influential trade groups was compromised by government interference. In some cases there has been controversy over the action of the chambers and in others the parasitic nature of those that have commandeered them. In still others, their politicization has created a circumstance where membership in them can become a disadvantage rather than an advantage for members of the business community, or otherwise have them supporting chamber action which is diametrically opposed to their personal and business interest.
Historically, chambers of commerce grew out of the medieval tradition of guilds, which were associations or fraternities of craftsmen based on their trades, such as textile makers, masons, carpenters, carvers, glass workers, chandlers, tinkers, millers, brewers and the like. Such confraternities were intended to provide protection to such tradesmen against outsiders or others that would seek to exploit them, as well as to keep secure trade secrets and methods. Chambers of commerce, which exist as a fraternity not of craftsmen of a specific type but businessman in a geographically defined locale, were intended as a bulwark against the excessive regulation and taxation imposed by governmental authority both local and national. The first such chamber of commerce was founded in 1599 in Marseille, France. Their nature and function have varied and evolved somewhat over the centuries, but strictly defined, modern chambers of commerce are forms of business networks, the ostensible goals of which are to further the interests of businesses. Business owners in towns and cities form these local societies to advocate on behalf of the business community. Local businesses and entrepreneurs are members, and they elect a board of directors or executive council to set policy for the chamber. The board or council then hires or elects a president, and appoints or hires a CEO or executive director, plus staffing appropriate to the size of the city or community in question, to run the organization.
As a non-governmental institution, a chamber of commerce has no governmental authority and no direct role in the writing and passage of laws and regulations that affect businesses. Traditionally, however, they are purposed to push for legislation to assist in the prospering of business and to lobby for governmental policies that are favorable to businesses.
Decades ago, governmental entities, recognizing that chambers of commerce represent a major, or in some jurisdictions, the major, impediment to certain governmental imperatives such as taxing and regulation proposals, moved to combat or otherwise compromise the chambers’ effectiveness. Generally speaking, governments have not sought to impose restrictions on the chambers’ functions as much as they have chosen to co-opt them. A major tactic in the municipal playbook on how to pull the teeth of these chambers consists of “helping” them rather than hurting them, i.e., subsidizing them, and in so doing ameliorating their policies and approaches.
It is not uncommon for a local chamber of commerce to derive funding from the city or town government where it is set up. In the Inland Empire’s Central Valley, which comprises ten San Bernardino County cities stretching from Redlands in the east to Ontario in the west, six of those ten cities subsidize the local chamber of commerce in annual amounts from $15,000 to $38,000, with the average calculated at just under $24,000. In addition to subsidies, three of those cities provide a rent-free location for their chambers.
The cities rationalize this monetary support by touting the “scope of services” the chambers provide to the community. This scope typically entails conducting networking/speaker engagements to provide information to and about businesses, creating and maintaining an internet presence for the chamber and thus the business community, conducting small business workshops, functioning as a labor liaison, coordinating grand openings and ribbon cuttings, preparing and maintaining a spreadsheet of businesses, working with the city to provide promotional materials, and conducting surveys of local businesses on a variety of issues. That justification, however, is merely window dressing. What the cities are buying with the money is the complacence of the chamber and its constituents individually and collectively toward the city’s efforts to achieve its goals.
On occasion, a city’s residents and business community will be treated to the spectacle of the chamber of commerce, officially as an organization, together with its leadership, pushing for business and community support of city policies that are diametrically opposed to the interests of local commerce.
In Upland in 2000, the city proposed levying a utility tax on all residents and businesses in town. Because they felt the chamber was beholden to the city for the financial support it had been providing to the chamber, a majority of the chamber board, over the objection of some board members and many of the chamber’s members, voted to have the chamber officially support the tax measure. That was a watershed event for the chamber, as several of its members broke ranks with the organization and joined in with the tax measure’s opposition. The measure failed at the polls 73 percent to 27 percent.
For many, the chamber’s action in supporting the tax rendered clear what had been a reality lurking below the surface for some time: the chamber’s function of representing the business community in the face of government excess or policies antithetical to the interests of the business community had been compromised to the point of corruption.
Similarly, businesses in Colton would go through the same learning process. In Colton, the chamber of commerce had grown into something of an official institution, akin to a special branch of government. The chamber office was housed in a portion of the civic center complex. By the late 1990s, the chamber had as its executive director Dick Dawson, a fellow with a very strong personality. Capable and gregarious, Dawson was effective in expanding the membership and reach of the chamber. But because the chamber, and Dawson, were reliant upon the city for subsidization and its offices were housed – gratis – in a city-owned building, the Colton Chamber of Commerce, like that in Upland, was blurring the distinction – and in some cases outright forcing a merger – between the interest of City Hall and the interests of the business community, even when those interests were at odds. And because it was the city government that was doling out the money for the chamber to maintain itself as a major community institution, whenever a true conflict arose between the business community as represented by the chamber and City Hall, the issues were almost always settled in favor of the city. So at one with the city’s advocacy and interest was the chamber that many people in Colton – including entrepreneurs and residents – thought Dawson was a city employee.
A tribute to Dawson’s capability and strength of personality is that the Colton Chamber of Commerce is today a vigorous organization with 143 corporate members in good standing.
Nevertheless, on no issue of substantial difference between the city and its business community does the chamber take a hard line against the city or its political leadership.
In Highland, Nanette Peykani, the executive director of the Highland Area Chamber of Commerce, has been waging a battle to keep the chamber relevant in the second decade of the Third Millennium.
In Highland, the chamber as in many places elsewhere had become a creature of government, or a partial creature of government, unable to sustain itself on funding from local businesses and instead highly dependent on, some might say addicted to, subsidization from City Hall. But with the demise of California’s redevelopment agencies due to legislation passed in 2011, the City of Highland’s vehicle for delivering a life sustaining subsidy to the chamber of commerce evaporated.
With that blow, sufficient revenue to provide Peykani with a salary was unavailable. Gamely, Peykani over the last eight or nine months continued to function as the chamber’s executive director, holding the organization together, virtually by strength of will.
At present, she is working toward reestablishing the chamber as a true representative of the Highland Business Community, one that is not beholden to, and thus independent from, City Hall. In seeking to do this, Peykani is restructuring the membership dues for the chamber, reducing the fee to join in an effort to grow the ranks of the chamber so it can indeed be a voice of authority at the local policy table.
And recently, the chamber has made sufficient headway in generating operating revenue to again provide Peykani with a paycheck.
Meanwhile, back in Upland, this year another illustration of how chambers of commerce have become an adjunct – some might say lap dog – of local government played out.
Eric Gavin, an Upland resident transplanted from Pomona and San Dimas, ran for city council in the special election held in 2011 to fill the vacancy created on the panel when councilman Ray Musser was elevated to mayor following the resignation and indictment of former mayor John Pomierski. Gavin was not successful in that elective bid, in which Debbie Stone was victorious, but Gavin has since been a mainstay at city council meetings, where he evinces a civic interest by often commenting on items that come before the council as part of the agenda as well as non-agendized issues about which he will express his heartfelt notions.
Gavin is also a member of the Upland Chamber of Commerce and, by all reports, was energetically involved in several of its programs. Among those was the chamber’s leadership academy, which is devoted to the cultivation and application of leadership skills. The six-month program involves workshops and seminars on a variety of societal, community and civic topics, including education, health care, public safety and municipal government. The academy is oriented specifically with regard to topics with an impact on Upland, and those attending it after each seminar or workshop brainstorm with regard to sizing up how that particular issue was impacting Upland and what potential solutions existed. So infectiously enthusiastic was Gavin about his participation in the most recently concluded leadership program that he was recruited to lead the current leadership program as its project manager.
Earlier this year, an effort to recall Musser as mayor manifested and Gavin signed an intent-to-circulate a recall petition document in support of the effort. On September 28, that recall effort was officially initiated when another Upland resident, Hal Tanner, served the recall petition on Musser at that evening’s city council meeting, just less than three weeks after Musser had been discharged from the hospital following triple bypass surgery, which took place on September 8.
With the serving of the recall petition, Gavin’s support of the effort to remove the city’s mayor became public knowledge. This was exacerbated by his decision to take a leadership role in the Musser recall effort, acting as the master of ceremonies at a recall committee formation meeting at the city’s senior citizens center.
Reflexively, Musser visited the chamber office to let chamber officials, including operations manager Terri Galdo and chamber board chairman Terry Jeffers, know that he was less than pleased with one of the chamber’s higher profile member’s involvement in the ongoing attempted political coup. Musser, who owns an insurance agency in Upland and was himself a past president of the chamber, said he felt that Gavin’s involvement in the recall effort might be construed as transforming the chamber into a political action committee. Further citing the coordination between the leadership academy’s recommendation process and the city council, to whom those recommendations are provided, Musser asked Galdo and Jeffers to either have Gavin rescind his endorsement of the recall effort or have the chamber remove Gavin as the leadership academy project manager.
Gavin protested that Musser had overstepped his authority as mayor in making the request of the chamber.
“I was shocked – shocked – to learn that the mayor had visited the chamber and told them that he would not support this program if I remained its project manager, simply because he saw my name on the recall petition,” Gavin said.
Protest as he might, Gavin was provided with a crash course in real life leadership principles, learning that when he stepped into the political arena he himself became a political entity himself and that the chamber is not above political machinations and alignments of its own. Though he claimed to be shocked, it is not surprising to many others that when push comes to shove, the chamber sided with the politicians in place at City Hall. Forthwith, Gavin was informed by the chamber of commerce he would no longer serve as the project manager of the organization’s leadership academy.
On September 29, Gavin dashed off a missive to the chamber board in which he somewhat belatedly acknowledged “the chamber is a political organization,” despite the chamber’s own resistance to being so defined. He further stated that “because my name, being potentially associated with an effort to recall Mayor Musser, could be a detriment to the success of the vital leadership program, I willingly defer to the chamber’s preference for handling this situation.”
The chamber board did not spare any time at all in making its decision to cashier Gavin as the program manager.
Stating “There were several factors that went into this decision, some of which were totally unrelated to Mayor Musser,” Jeffers publicly explicated the reason the chamber was distancing itself from the individual it had until that point considered an exemplary community leader: “It is crucial that the person who holds this position interface closely with city council members, including the mayor,” said Jeffers.
On October 9, Gavin received an email from the chamber’s executive board of directors informing him it had been “decided that you can no longer act effectively as project manager for the Upland Leadership Academy, a strictly non-political organization. As a result, the board has passed a motion to remove you from that position as of this date.” The email further states, “The success of the leadership academy is significantly dependent on the active support of Upland’s current leadership, and cannot tolerate any hint of political discord in implementing its program.”

Melee Trashes Classroom at YV Community Day School

YUCCA VALLEY—Things got out of hand this week at the Yucca Valley Community Day School, a specialized campus for troubled students with a problematic scholastic history.
A fight between two students in one class devolved into what was described as a mini-riot that remarkably confined itself to one room. Somewhat miraculously, no one was injured in the fracas that embarrassed both school officials and the sheriff’s department.
By the end of the incident, one juvenile was under arrest for violation of Penal Code 242 – assault/ battery and eight others had been cited for Penal Code 404(a) – participating in a riot.
At around 11:10 a.m. on Tuesday December 8, two students started fighting in a class in the Green Building at the Yucca Valley Community Day School at Yucca Trail and Barberry Avenue. The melee escalated and faculty and staff were unable to quell the disturbance.
Sheriff’s deputies were summoned. Dispatched to the campus were deputy Shaunna Ables and detective Heidi Hague. Informed that at least a half dozen students were out of control, throwing objects, including desks, and pushing and resisting teachers in an aggressive manner, Ables and Hague waded into the breach, succeeding in identifying and removing from the classroom the two students whose fight had touched off the incident. When the sheriff’s officers exited the classroom with the teacher to get an account of what had taken place and were in the adjacent hallway, several students yet in the room boldly slammed the door behind them. Further vandalism to the room ensued, with bookcases being upended and desks, chairs and trash cans being hurled. The two sheriff’s officers, despite remonstrations, were unable to get the students inside to open the door. Within a few minutes, however, a faculty member produced a key and the door was opened.
The sheriff’s officers immediately reasserted command presence, gaining control of the students, interrogating them in successive fashion, sifting their statements, and playing one witness off against another. Through this process they ascertained that one student had engaged in assault and battery and that eight others had willingly participated in the vandalism. The student who had engaged in the assault and battery was arrested; the eight others were cited for engaging in riotous conduct. They were given a date to appear in court to answer the charges and released to their parents.
The Yucca Valley Community Day School is one of more than 350 schools in the Community Day School network throughout the state. Functioning under the aegis of local school districts, Community Day Schools are devoted to salvaging students who have been dogged by truancy, poor performance, lackluster or bad grades and behavioral issues. Community Day Schools employ teachers who are specially equipped and trained to pursue educational and socializing strategies to help such students find self-worth, experience joy in attending school every day, value learning, take pride in academic performance, accept responsibility for their own actions and provide them with a sense of family or belonging within an academic setting, while preparing them to hopefully move back into regular schools. Community Day Schools as a matter of course require teachers with an even greater degree of patience, compassion and assertiveness than teachers in traditional academic settings. Community Day Schools also benefit the students who do not attend them in that they remove from the student population at the standard schools many of the individuals who prove disruptive to the normal academic setting.
An obvious problem with Community Day Schools is that they congregate students with a high disruptive potential. The event in the Green Building classroom at the Yucca Valley Community Day School on Tuesday was an unfortunate manifestation of that potential.

Yermo Recall Proponents Claim Sufficient Signatures To Remove Smith & Berner

Advocates for the recall of Yermo Community Services District board members Bob Smith and Geoff Berner have collected what they believe to be a sufficient number of signatures on petitions calling for an election in which voters will be asked to remove the pair from office.
At the September meeting of the Yermo Community Services District Board of Directors, recall proponents served Smith and Berner with a notice of the petition to recall. According to the San Bernardino County Registrar of Voters, the recall proponents must have their petition endorsed with 189 valid signatures of registered voters within the district to force a recall question onto the ballot.
Recall proponents believe they have passed the 189 signature threshold, and submitted 250 “raw signatures” to the San Bernardino County Registrar of Voters on December 2. The registrar now has 30 business days to verify the signatures. Given the relative size of the district, however, it is anticipated that the verification process will be finished by next week. If at least 189 of those signatures are verified, the district will be informed of the certification and will then have 14 days to call for an election. The election must be held at least 88 days after but no more than 125 days from the district board’s action in accepting the certification and calling for the election.
The recall effort, led by organizer Michael Cint, is based on assertions that both Smith and Berner have not accepted responsibility for their actions which have been damaging to the community.
If successful, the recall would significantly undercut the governing authority in the district and create a new ruling dynamic there. Cint’s group also served board member Sean Cloughen with an intent-to-recall notice at the same time Smith and Berner were served, which prompted Cloughen to announce his immediate resignation from the board before the meeting was concluded. His formal resignation letter has been submitted and accepted, leaving the board one member short.
A malaise has gripped the board in the aftermath of the recall move, and last week it was learned that the district’s general manager, Melissa Martin had resigned her position. In November, Smith and director Gary Yearsley were no-shows for the board meeting, such that there was no quorum and the meeting was cancelled. Finding a replacement for Martin is now on hold and the district is in a practical state of paralysis.
It is unclear whether any potential replacement candidates for Smith and Berner will step forward. State law is unclear as to whether a recall election can proceed if candidates to replace the elected officials targeted for removal are not available.

The historic ASU Fox Theater was originally opened in 1929 and was the site for the West Coast premiere of the original “King Kong” film in 1933. Located at 374 West Court Street, the ASU Fox Theater is just a block from City Hall, across the street from the Bank of America.
