Hello…  Spring has exploded here in sunny Calfornia. As a matter of fact, last weekend was booming with radiant brightness and color. It briefly felt like summer. People, especially the kids, were out in their cooler clothes. The revolution of fashion is being established this spring, and people are wearing whatever they want. It boils down to freedom and fun. The high season of spring is here and the sight is phenomenal, seeing people wearing colorful hats, shorts, skirts, and babies in cute bonnets. It’s all about decorating the body down here in San Bernardino County and people are  looking quite lovely. I also noticed that the  main stream of fashion today is about downsizing and simplicity. One example would be a skirted  gray suit with a refreshing white shirt. Simply lovely! Fashion right now is being  uplifted by simplicity. Making spring super  fun! Its wonderful to see how drastically fashion changes from day to day. Have revolutionizing your fashion sense this spring.

No Clarity On State Applying Water Restrictions On Nestlé/Arrowhead

Of tremendous moment in the San Bernardino Mountains is whether Governor Jerry Brown’s April 1 executive order mandating that cities, towns, counties, agencies and individuals across the state reduce water consumption by a minimum of 25 percent will be applied to Nestlé Water of North America, the parent company of Arrowhead Water, the bottler of Arrowhead Spring water.
Arrowhead Water’s precise consumption of water has, remarkably, never been publicly disclosed. Nestlé of North America, a corporate subsidiary of the Swiss-owned Nestlé Corporation, had  permits with the United States Forest Service  allowing it to extract water from a significant spring in the San Bernardino Mountains. One of those permits expired 28 years ago and the other expired 21 years ago, but the company continues to pay the miniscule fees associated with those permits and utilizes for commercial purposes water thousands of times in excess of that used by local domestic users who even before Brown’s executive order had their access to mountain water cut off.
Originally conceived of in the late 1800s, Lake Arrowhead came about as a consequence of the construction of Lake Arrowhead Dam, work on which began at end of 1904. Work was suspended on that effort because of litigation over the project’s diversion of water away from the headwaters of the Mojave River on the north side of the Mountain. After an extended delay, construction of the dam was completed in 1922 by the Arrowhead Lake Company, a Los Angeles syndicate.
Well before that, in 1906, in Strawberry Canyon, at a level in the San Bernardino Mountains below the lake, pipes were used to tap into the springs fed by Strawberry Creek. The flow from those pipes became a reliable drinking water supply. That was one year before the San Bernardino National Forest was created by an act of Congress. In time, the original pipes at Strawberry Springs were enlarged and expanded and the Arrowhead Puritas Water Bottling Company built its company, based on the quality of that spring water.
Nestlé inherited from Arrowhead Puritas the water pumping permits issued by the U.S. Forest Service to the Strawberry Canyon spring water, when it purchased that company. But one of those  permits elapsed in 1988 and the last one expired in 1994. Nevertheless, Nestlé has continued to pay the $524 annual fee attached to those permits, and continued to extract water unabated from Strawberry Springs, conveying the water away in a stainless steel pipeline.
There is no limitation imposed on Nestlé’s pumping. Nor has there ever been an effort to quantify how much water, precisely, Nestlé is using.
A multinational food and beverage company headquartered in Vevey, Switzerland, Nestlé is the largest food company in the world measured by revenues. According to its 2014 report to its stockholders, bottled water accounts for seven percent of the company’s revenue. Most of that is from the Arrowhead brand.
Neither the U.S. Forest Service, nor the state of California, nor the county of San Bernardino nor any local water agency has required that the water being drawn from Strawberry Springs be measured. In this regard, Nestlé appears to be getting no special treatment when it comes to water bottlers, since none of the state of California’s 108 water bottling plants is required to report how much water is being used in their operations. The only state regulations at such plants pertain to purity, content, turbidity and bacterial measurements.
Still, Nestlé/Arrowhead does appear to be getting favorable treatment in one other regard.  Beginning in 2006, the Forest Service began to limit the water usage of hundreds of residents in the San Bernardino Mountains, reevaluating the permits those residents had for the use of creek, spring and well water. Many, if not all of those residents had long established water rights. Nevertheless, the cabin owners were told by the Forest Service that they would no longer be allowed to draw water from mountain creeks. They would instead need to exclusively use wells or, in the case where they had no wells, build tanks and truck in water. In many cases the cabin owners had documentation showing water rights extending back for more than eight decades. That softened no soap with the U.S. Forest Service, which threatened legal action if the taking of water from the creeks did not cease, and the impacted cabin owners were required to make immediate investments of upwards of $5,000 apiece and continue with the ongoing expense of purchasing outside water to maintain the liveability of their domiciles.
The Forest Service has not offered its rationale for excluding Nestlé/Arrowhead from its permit reevaluation process, even though the Arrowhead water bottling entails the drawing of, based upon internal Nestlé corporate documents, at least 705 million gallons of water from Strawberry Spring annually, which translates into more water in two weeks than the cracked-down upon cabin owners all over the mountains were utilizing in a whole year. Estimates by hydrologists not affiliated with Nestlé put the company’s water consumption significantly beyond the 705 million gallon mark.
It may be that the U.S. Forest Service, a federal agency, is reluctant to, or under orders not to, confront an international company operating in the United States and thereby create some order of international incident and invite retaliation against American companies operating overseas.
But with California now caught in what scientists say is the most severe draught the state has suffered in 1,200 years and the governor’s executive order extending to every part of California, it remains to be seen whether Nestlé can continue to defy the rules and regulations all others in the state must abide by.

SB Publisher Advocates Downtown Turnaround As Priority In City Makeover

(April 13) Wallace Allen, the publisher of a San Bernardino newspaper for more than a quarter of a century, offered up what he considers to be a viable strategy for rejuvenating the dilapidating downtown section of the county seat.
San Bernardino is the county’s oldest city, having been founded in 1810 as an east-lying adjunct to San Gabriel Mission to minister to the native Guachama and Gabrieleno Indians. It officially incorporated as a city in 1854. From the inception of San Bernardino County, it has been the center of county government and throughout much of the county’s 160-year history, San Bernardino was the predominant community, socially, commercially, politically and culturally. More than a quarter of a century ago, however, its position as the hub of county commerce began to erode and its luster in nearly every other venue has dimmed. The shuttering of Norton Air Force Base in 1994 hastened the city’s decline and over the last two decades the local economy has crashed and burned. In 2012, after years of deficit spending, the city filed for Chapter 9 Bankruptcy protection. The city has yet to emerge from that status, although the judge hearing the case, Meredith Jury, has set a May 30 deadline for the city to deliver to her its bankruptcy exit plan.
Allen, who founded his newspaper, The Westside Story, in 1987 and has published it weekly ever since, has been a firsthand witness to San Bernardino’s sorry decline.  As one of the few downtown-based entrepreneurs who has managed to sustain his operation and even thrive, he is able to speak with some degree of authority about what is ailing the city and its economy. And he has some ideas about what steps city officials might proactively take in righting the listing financial ship.  This week he spoke with the Sentinel at length about his vision.
Those officials need not venture far to start, Allen said. From the steps of City Hall, one could throw a rock and hit the first object that would be his first order of business. His reference is to the Hotel & Convention Center at 295 North E Street, which is adjacent to San Bernardino City Hall to the south and just west of the Vanir Tower.
“I am told the hotel is owned by a Saudi prince,” Allen said. “Someone got energetic about it a while ago and began to look into it, but no one could find out which Saudi prince, exactly, was the owner. It has just been sitting there, with the convention center as its basement, doing nothing for a decade or more now.  It is located in a place of very high visibility in this city. Everyone just accepts that as the status quo. Meanwhile, you have code enforcement going into neighborhoods that are way off the beaten track, citing one homeowner after another for neglecting their yards or letting the stucco on the side of their houses fall into disrepair.
“Those houses are not in the limelight,” Allen continued. “They are in residential areas where very few if any outsiders ever travel. When someone from out of this area who has investment power comes to San Bernardino, the place he is most likely to come to and get his lasting impression from is downtown. That is San Bernardino’s window to the world. I think our civic leaders have lost sight of that. It is downtown where we should be training our code enforcement forces. And the first place we would start, if I was the decision maker, would be the hotel and convention center. I would use every resource we have at our command, legal, code enforcement and otherwise and based on the length of time it has just been sitting there blighting, we would seize possession of the hotel and make an impressive transformation, or at least start the transformation.”
And how, exactly, would Allen transform the hotel?
“My vision is high end office/professional uses on the first floor,” he said. “Something that would make a real statement and would draw the type of clientele that would broaden the appeal of not just downtown but San Bernardino in general. The two top stories would be residential, permanent residences, with penthouses on the top floor.  The floors in between would remain as the premier downtown hotel.  The way I conceive of this is it would be comparable to what you see in other major cities, San Francisco, Seattle, San Jose, something that isn’t unique, but is distinctive, and which puts our best foot forward when we have visitors from outside the area who are maybe looking to relocate a business or are just passing through for one reason or another but might in the future have a reason to branch out elsewhere, invest or start up something. First impressions are always important.”
Allen then turned to a second rapidly deteriorating downtown landmark: The Carousel Mall.
“Who owns it?” Allen asked rhetorically. He then noted that the city holds title to practically all of the commercial center, with the exception of the Harris/Gottschalks building, owned by El Corte Inglés S.A., a Spanish department store operating firm, and the J.C. Penney’s store, now owned by the San Manuel Band of Mission Indians.
Construction on the Carousel Mall began in 1971, at a location that had been the site of the old Harris Store since 1927. In 1972, it opened as the Central City Mall, anchored by Harris, J.C. Penney, and Montgomery Wards, and including 49 other stores. At its peak in the mid 1980s it boasted more than 100 tenants. In the late 1980s it was renovated, and a carousel was installed in the bottom floor, at which point it was rechristened the Carousel Mall. But its fortunes waned with those of the rest of San Bernardino over the years, and by the late 1990s, it began to decline. The first major blow came when Gottschalks, which had bought out Harris, elected to close at that location in 1998 and relocated in the Inland Center. Three years later, in 2001, Montgomery Ward went out of business. At that point, J.C. Penney was the sole anchor. In 2003, J.C. Penney closed. The mall was sold in 2006. Lynwood-based developer Placo San Bernardino LLC, purchased  a major portion of the mall in 2008 for $23.5 million, with serious designs on reinvigorating it and obtaining short term financing to undertake improvements, signaling it was on a crash schedule to do just that.  But that same year, CinemaStar shuttered its theater on the mall’s grounds.
In May 2010, with its plan stalled, Placo was failing to make its payments to Center Bank, which had provided a $16.5 million loan for the planned renovation.
The  city of San Bernardino’s economic development agency swooped in and bought the property’s note and deed trust from Center Bank for slightly over $13.1 million.  At that point, the city, based on backroom discussions with county officials, had visions of filling large portions of the mall with county offices. But those plans have fallen through and the gargantuan mall stands now, a neglected and obvious eyesore, a testament to San Bernardino’s economic collapse.
“The city’s ownership of that mall is a red flag to any possible investor,” Allen said. “Obviously, if it was a prime commercial venue, a corporation would already be operating it with a half dozen major tenets and fifty or sixty smaller ones. So, who is going to risk getting involved? No serious investor, who after all is going to want to see a return on putting up that kind of money, is going to risk getting involved. So, what possibility is left?”
Allen then answered the question he had posed.
“If I was in charge over there, I would send an emissary to every college and university within 30 or 40 miles – Cal State San Bernardino, San Bernardino Valley College, Loma Linda University, Redlands University, UCR, Chaffey College, the Claremont Colleges, the University of LaVerne – and I would offer them free classroom space in the mall for them to locate their satellite campuses for the next three or four years. I would allot half of the mall for classrooms and reserve the other half for every conceivable type of business that caters to college students. This would be the perfect marriage between multiple entities. The city has more space than it can possibly deal with and no realistic prospect of bringing in any significant number of tenants without first engaging in major reconstruction and renovations. The schools need classroom space and outreach programs. We have a population that needs to be educated and provided with skills so they are employable and have earning potential. Why not bring all of those different needs and resources together?”
Allen, who fits within the mold of a social liberal in may respects, nonetheless reflected an attitude rising out of his own status as an entrepreneur, decrying the lack of imagination and initiative of local governmental officials and what he freely referred to as “bureaucrats” who have control over the public sector and appear paralyzed in their response to San Bernardino’s economic challenges. That paralysis, Allen said, is an outgrowth of the bureaucrats’ comfort level.
“There is a lot of talk about how serious the problems are and how things need to be turned around and there is a periodic panic over doing something, but everyone with the power or position to actually act has a good paying job and a paycheck, so it really isn’t a big deal for them,” Allen said. “They’re still riding the gravy train and nothing gets done. There is no real incentive for them to empower the ones out on the streets who are struggling, or to reignite hope or passion in the ones who have been beaten down so long that they have given up.”
What is needed, Allen said, is for those who have been fortunate enough to be entrusted with government positions and authority to recognize that they are not entitled to the advantage they have been given. Rather, he said, they should utilize the privilege that has been extended to them to serve their constituents and the citizens from whom their authority originates.

After Swift Exit From SB, Williams Resurfaces As Finance Manager In Upland

(April 14) Scott Williams, who made a hasty and ignominious exodus from San Bernardino last month as that city’s finance director, has resurfaced as Upland’s interim finance manager.
Williams was hired by San Bernardino in December to replace David Cain, but lasted only to the second week of March at the county seat.  Two weeks later, on March 25, he was given the temporary billet as Upland finance manager as the City of Gracious Living was looking to replace Christa Buhagiar, who left Upland to go to work in West Covina. Williams had the opportunity of working two days with Buhagiar before she departed, giving him an opportunity to acclimate himself.
It is an open question as to whether Williams will apply to succeed Buhagiar, when the finance manager position, which pays $225,418 per year in total compensation, is filled on a permanent basis.
An atmosphere of intrigue appears to surround Williams, as did it Buhagiar, and the finance director position in San Bernardino and finance manager post in Upland. The top finance posts in both cities are complicated by the financial challenges each face. The circumstance in San Bernardino is more dire than it is in Upland.
After two decades of mounting financial challenges and almost ten years of deficit spending, San Bernardino in 2012 filed for Chapter 9 bankruptcy protection. It has yet to emerge from that status, though its plan to do so is due for review by the judge hearing the bankruptcy, Riverside-based Federal Bankruptcy Judge Meredith Jury, on May 30.
Williams’ predecessor in San Bernardino, David Cain, lasted 18 months in the position, having been hired in March 2013 and exiting in September 2014.
Beginning just before San Bernardino’s 2012 bankruptcy filing, each of that city’s annual budgets have been constantly reworked from previous drafts, provisionally balanced upon wishful or overly optimistic revenue projection but in reality reflecting  inexact and differing actual deficits, typically totaling in the tens of millions of dollars.
The Herculean task of arriving at budgets for the county seat took its toll on Cain, who upped and quit three months after San Bernardino passed its provisionally-based current 2014-15 budget.  A telling feature of his exhaustion was that in June, after having put the unwieldy fiscal figures onto paper, Cain was not up to the task of attending the city council meeting where the budget was passed, where he would have needed to withstand the firestorm of protest over the cutting he had done. Neither did San Bernardino City Manager Allen Parker.
Both of Parker’s predecessors as city manager, Charles McNeely and interim Andrea Travis-Miller, were undone by San Bernardino’s financial challenges. McNeely left just prior to the city’s bankruptcy filing.
Williams was lured from Northern California to come into the vacuum Cain’s departure created, and he arrived in San Bernardino in December. But he soon proved inadequate to the overwhelming task he had accepted.
The month prior to Williams’ arrival, Jury had set the May 30 deadline for the presentation of bankruptcy exit plan and its attendant documentation for presentation. Complicating this was that last spring, San Bernardino had jettisoned its previous auditing firm – Rogers, Anderson, Malody and Scott – after it demonstrated itself as unable to get its arms around the city’s financial picture and the audit it was supposed to complete for fiscal year 2011-12 – just as the city was heading into bankruptcy – literally took two years to complete. That document was not submitted until June 2014.
The city then brought in the Macias, Gini and O’Connell LLP accounting firm, depending on that company to provide a transparent profile of the city’s financial condition overall as well as its income and outgo, liabilities and assets, investments and rates of return, reserves and balances.
In June, the council approved a contract with Macias, Gini and O’Connell, LLP to perform an independent audit of the city’s financial records for the fiscal year ending June 30, 2013 and the fiscal year ending June 30, 2014, at a cost of $218,086. But despite the representation by  Macias, Gini and O’Connell that it would be able to carry out the auditing in a timely manner, the firm had made seemingly little, if any progress toward that goal when Jury’s deadline was announced in November.  Four months later, in early March, the firm gave indication it would most likely be unable to hit the May 30 target. One of the reasons for that delay, San Bernardino City officials would claim shortly thereafter, was because Williams had control of the information the auditing firm needed to go over to make its report but that Williams had dithered, carrying out his own review, even though assistant city manager Nita McKay had been pushing him to turn over to Macias, Gini and O’Connell everything the firm needed to do its work.  Williams was shown the door.  According to Parker, some order of personality conflict had emerged between Williams and McKay, and McKay had petulantly balked at working with McKay and taking orders from her, even though she was higher in the municipal pecking order than he was.
Meanwhile, in Upland, another intrigue-filled drama was playing out.
Back in 2013, Christa Buhagiar had been hired by then-city manager Stephen Dunn to serve as that city’s finance manager. Dunn had been Upland finance manager before he was elevated to the city manager’s position in 2011, and for two years had filled the dual roles of city manager and finance manager.  Buhagiar came into the finance manager position to reduce the work load on Dunn shortly after Glen Bozar, who had been elected in 2012, assumed his position on the city council.
A self-styled “taxpayer advocate” intent on effectuating financial reform in Upland, particularly reining in what he considered to be excessive employee salaries as well as current and future pension costs, Bozar wanted strict financial assessments of all order of city functions made, economies applied, unnecessary spending to be identified and eliminated and no further imposition of taxes or fees on residents or businesses levied until all means of cost reductions were exhausted. Bozar wangled an appointment to the city council’s two-member finance committee, from which post he undertook his effort at financial reform in earnest.
Buhagiar, who soon recognized that Bozar was a lone wolf with regard to aggressive financial reform and that the remainder of the council had a far more laissez faire attitude with regard to that issue, proved less than fully accommodating of the reforms Bozar was advocating. Because Buhagiar never embraced Bozar’s agenda for pension and payroll reform, the resulting dissonance between a key finance committee member and the city staff person most closely involved with municipal finances was never resolved.
During her tenure with Upland, Buhagiar had developed a close working relationship with city attorney Kimberly Hall Barlow. Hall Barlow left the city under a cloud late last year when she defied the city council’s instructions on the tenor of a letter to be written to the Colonies Partners land consortium over the lack of progress with regard to the development of former city property encumbered by a revisionary clause that was entrusted to the Colonies Partners to improve. Hall Barlow surfaced as the city attorney in West Covina.  By late February, arrangements were made for Buhagiar to jump to the finance director position in West Covina. In early March, her resignation as Upland’ finance manager was abruptly announced.
With Buhagiar leaving Upland in the lurch, the timing of Williams’ departure from San Bernardino proved fortuitous for Upland and Williams. In this way, Williams was without gainful employment for less than two weeks, and Upland was able to have him in place two days before Buhagiar actually departed for West Covina, allowing her to show him at least some of the ropes.
Upland City Manager Rod Butler said that Williams is not a CPA as is Buhagiar, but that he has extensive experience in working budgets and in information technology systems.  This last talent is of some moment, as Upland has just moved to acquire a $2 million city-wide accounting system that will allow the city’s entire financial function, department-by-department, to be profiled and closely monitored  on a day-by-day, hour-by-hour, minute-by-minute basis.
Butler offered assurances that an adequate background check of Williams had been carried out, covering his employment history as the lead financial adviser for the Regional Governmental Services Authority in Napa and the finance director in Sonoma as well as his more abbreviated stint in San Bernardino. Butler said he believed Williams had the requisite knowledge and skill to serve as the interim finance manager. He said he would “certainly be eligible” to apply to fill the permanent position of finance manager when that recruitment effort is undertaken.
As to his experience in San Bernardino, Williams told the Sentinel, “I am not at liberty to discuss that.”
Dunn, who has since retired as Upland city manager, to the Sentinel, “Mr Williams will have some of the same challenges he had at San Bernardino plus responsibility to install a new accounting system. It will take a huge effort on his part to be successful. I wish him luck.”

Firefighters Sue SB Over Pay And Manpower Reductions

SAN BERNARDINO—(April 14) San Bernardino City Professional Firefighters, the bargaining unit representing San Bernardino’s firefighters, filed a pair of lawsuits on April 9 and April 10, asserting the city has run afoul of the municipal charter in imposing rampdowns on firefighter pay and benefits.
In San Bernardino, the pay level of the city’s safety employees – its police officers and firefighters – is controlled by a provision – known as Section 186 – put  into the municipal charter by means of a citywide vote in 1939. Section 186 requires that policemen and firemen be paid on a scale equal to the average pay of police officers and firefighters in ten similarly-sized California cities.
But San Bernardino has been on a steady financial decline for more than two decades and in 2012 nearly ten straight years of deficit spending came home to roost when the city filed for Chapter 9 bankruptcy protection. Almost three years later, the city has yet to fully formulate its financial recovery and bankruptcy exit plan.
Section 186 effectively locks in salaries for San Bernardino’s public safety employees that are at par with or greater than those salaries received by their counterparts in ten California cities. San Bernardino, the county seat and the largest city in the county, has a population of 213,708. Yearly, city officials and police and fire union heads start with a list of California cities with populations between 150,000 and 250,000. In turns, each removes a city from that list until ten remain. Salaries are then computated upon the average pay to that particular group – firefighters or fire department management or policeman or police management – in the remaining ten cities.
Former mayor Patrick Morris, whose eight years in office ended last year, for the last several years of his tenure  maintained that a major factor in the city’s fiscal deterioration has been excessive salaries and benefits provided to city employees and retirees. Carey Davis, an accountant by profession and a political ally to Morris, succeeded Morris in March after defeating Wendy McCammack, a former councilwoman who had long championed generous pay increases for municipal safety employees.
The Morris-led council, over the strenuous objection of councilman John Valdivia, who came into office as the result of heavy police department union backing, has explored overcoming the requirements that San Bernardino maintain police officer and firefighter pay levels  remain on a par with California cities that are not struggling with the same financial challenges it is.
In September 2014, U.S. Bankruptcy Judge Meredith Jury, who is overseeing San Bernardino’s bankruptcy petition, ruled that the city could reject its existing contract with its firefighters. Jury’s finding was limited in scope, and it did not, per se, granting the city license to impose a contract on the firefighters unilaterally, but suggested that some form of traditional collective bargaining could be carried out.
In October, a divided city council voted 4-3, with mayor Carey Davis, Virginia Marquez, councilmen Jim Mulvihill and Shorett in favor and Valdivia and councilmen Benito Barrios and Henry Nickel opposed, to alter the city’s pension plan for its firefighters and have the fire department to shutter one of its fire stations and the implementation of “constant staffing,” which involves a strategy by which the department schedules a minimum number of staffed fire engines or paramedic units at all times and apportions those crews by number to correspond with peak usage periods in an effort to reduce manpower demands and head off excessive overtime. The firefighters at that time objected to the move, in particular to imposing the pension changes, and its union representatives threatened to sue the city over the issue.
Last week the firefighters union came through on that threat, asserting city officials are violating San Bernardino’s charter in an ongoing pay dispute.
In a press release,  San Bernardino City Professional Firefighters President Jeff English said the city’s action in defiance of Charter Section 186 is illegal and “slap in the face” to residents who voted against Measure Q, a city council sponsored initiative aimed at altering Section 186, which was placed on the ballot in November. Measure Q, which was stridently opposed by the police and fire unions who ran a well-funded campaign against it, failed.  “We want to stop these violations and ensure that city leaders follow the laws that they have pledged to uphold,” said English.
The suits were filed in U.S. Bankruptcy Court in Riverside. They petition for the vacation of the changes voted in by the city in October.
The suits followed by three and four days action by the San Bernardino City Council on April 6 to approve, again with Valdivia dissenting,  a “good governance” agreement which stipulates that the council seek to expeditiously “produce a confirmable plan of adjustment for council approval by May 30, 2015” so the city can make an exit from bankruptcy. The good governance dictum implies that elements of the city’s charter may need to be ignored, suspended or altered to achieve those goals.

Adelanto Councilman Camargo Disputes Report He Is No Longer Living In The City

ADELANTO—(April 13) In the last several weeks there have been recurrent and persistent reports that Adelanto City Councilman Ed Camargo is no longer living within the city and that he had moved into his girlfriend’s home in Victorville.
Camargo has denied the accusation, deploring what he said are patently false rumors that malign both him and the city.
“I live here in town,” Camargo stated publicly at the April 8 city council meeting. Camargo decried the effort of some to delve into his personal life and elevate it into a political issue.
“So I was dating someone in Victorville,” Camargo said. “It’s none of your business,” he said. “We talk about being transparent [but] I don’t have to put my whole personal life out there. I’m done with that rumor. I live in the city.”
Camargo said he needs to stay in Adelanto, since his mother, who was wounded in a knife attack eighteen years ago, lives with him. He said he resented his personal issues being trotted out for public display.
“Get my family out of your mouth,” he told his critics. Anyone who wants to dwell on his personal minutiae, he said, should “come talk to me.”
Camargo’s personal life first loomed into the public spotlight late last year, when he voted on November 19 to approve Geo Group Inc.’s proposal to establish at the northeast corner of Holly and Koala roads in Adelanto a privately-run prison to hold 1,050 inmates from the California Department of Corrections.
Camargo’s girlfriend is an employee of Geo Group, which already operates two detention facilities in Adelanto, an Immigration and Customs Enforcement facility and Desert View Modified Community Correctional Facility.
It was alleged that Camargo’s favorable vote for the Geo Group project constituted an illegal conflict of interest because, it was alleged, Camargo and his girlfriend had commingled their financial affairs. California Government Code 1090, which prohibits a public official from participating in a decision in which he or she has a financial interest.
Camargo acknowledged after the vote was taken that his girlfriend works for Geo Group but he denied that he and she were cohabiting. Ultimately, Geo Group dropped its bid to open a third facility in the cash-strapped city, essentially closing down the conflict-of-interest, particularly a violation of Camargo said he has kept his finances separate from his girlfriend’s, and that they do not cohabit.
There is special sensitivity in Adelanto about residency and elected official eligibility issues. In 2004, Zoila Meyer was elected to the Adelanto City Council. Meyer was born in Cuba and had emigrated to the United States with her parents when she was a toddler. While she assumed she had been naturalized, she had in fact not been. Officials undertook an investigation, her lack of citizenship was confirmed, and she was removed from office and charged with having fraudulently voted and run for office. In April 2006, she pleaded guilty to a misdemeanor charge of fraudulent voting and was placed on probation, fined and ordered to pay restitution. Subsequently, deportation proceedings were initiated against her.
There is no dispute about Camargo’s citizenship. The San Bernardino County District Attorney’s Office has a less than stellar record in prosecuting residency cases such as that which Camargo’s detractors allege applies to him. More than two decades ago, in a case prosecuted by deputy district attorney Karen Ferraro, former Fontana city treasurer Ron Hibble was charged with not being a resident of Fontana while holding the elected treasurer position. Ferraro alleged, proved and Hibble acknowledged that he was sometimes absent from his Fontana home and often spent the night at his girlfriend’s residence in Grand Terrace. The jury ruled, however, that Hibble nonetheless still had a residence in Fontana, and he was acquited.

Fast Tracking Of General Plan After 7-Year Delay Alarms Upland Residents

(April 16) The emergence of Upland’s updated general plan and the fast track for its approval by the city council has alarmed a number of Upland residents and business owners.
Seven years ago the city began the effort to update the general plan. It made very slow progress for four years, with only a minimal amount of  public input into the process. Now, a tentative document is ready, but it has not been widely distributed. It is accessible at a relatively obscure spot on the city’s website and is available to be examined at City Hall and at the library.
The Upland Planning Commission is scheduled to hold a public hearing on it on April 22 at 6:30 p.m., at which time the commission is scheduled to make a recommendation for its adoption by the city council The city council is set to hold a study session for the general plan and its accompanying zoning changes on May 18. Sometime shortly thereafter, the council will vote upon its adoption.
What some in the community find objectionable is that the process crawled at a snail’s pace for more than six years, shrouded for the most part, in the backrooms of City Hall and now it is progressing at near light speed toward approval, with the public being shoehorned into just a very limited set of open hearings at which its input can be obtained.
At over 2,000 pages, the updated general plan has yet to be seen by the vast majority of the city’s residents or entrepreneurs. The few who have seen it and contacted the Sentinel say they have not been able to fully assimilate it and much of its implication.
A utility bill mailing to Upland residents heralded the general plan update.
“The comprehensive update program was completed as a result of ongoing community participation,” the notice states. “The community input process helped form the vision and key themes that have laid the foundation for the plans; directed the preparation of general plan goals, policies and actions; and formed the zoning code development standards and design guidelines.”
Upland resident Marilyn Mills, however, questioned the city’s claim of community participation. She said she was able to ascertain that there have been only three actual events at the beginning of the process where the city actively sought to get citizen input and those venues were related to other topics which greatly compromised the effectiveness of the gathering of resident feedback.
“Those events where the update effort was introduced were the Scary-A-Fair, Craft Fair and the Christmas Parade in 2008, where a lot of those in attendance did not even live in the city,” Mills said.  “Since 2008, the Planning Department has had four workshops and one open house where the public was invited. None of these were widely advertised with only a notice on the bulletin board at City Hall and in the legal section of the newspaper. If that is what they say is working with the citizens, that is unacceptable. This Plan and Environmental Impact Report was just now widely presented. There has been no in-depth citizen discussion and no time to give thoughtful researched answers.”
Moreover, Mills said, those the city targeted in distributing the new draft general plan demonstrated the effort to bring those who will be most impacted by the plan’s contents – city residents – are being overlooked. “A lot of agencies are on the document distribution list and developers who have businesses here, but that’s about it,” she said. “There are no other residents listed.”
The rush is keeping the public and officials from giving the document the examination it should get and not allowing the back-and-forth exchanges, debate and alterations needed to produce a quality plan and ensure that citizens’ concerns about the environment they are to live in are being addressed, Mills said.
Her initial reaction in the limited time she has had to study it, Mills said, is that it could use some revision.
“Now that we have read it, we can see it provides new zoning for high density, low income residential all along Foothill Blvd., with a lot of mixed uses in there.” she said.
In her view, she said, the plan deviates from some traditions she and many others have come to accept as part of the Upland community.
“The plan has a political philosophy attached to it,” she said. “It basically changes the character and values of Upland. It has an emphasis on public forms of transportation rather than moving freely about using cars.”
Another Upland resident, Marian Nichols, decried the suddenly accelerated plan update effort as a “stealthy  flim-flam orchestrated by the Upland Planning Commission and City Hall.  The citizens were not aware this was afoot.”
After she read the plan online, Nichols said, she “found it stunning.  It is against everything a lot of us envision for Upland. I was raised in Upland and I care deeply about the town of my birth. I attended each and every previous planning session.”
Neither her input nor that of other residents and business owners was heeded by those who put together the proposed new planning document, Nichols said.
”We sere involved for endless hours, as one after another company through the years presented its goal for us to explore. The companies left in disgust after the city didn’t sign them up.  And we citizens became disillusioned when the fruits of our labors disappeared into thin air.”
The updated general plan,  Nichols said, is inferior to the previous one, clearing the way for over-concentrations of population in the city that will erode the quality of life.
“What is being proposed is to transform Upland into the antithesis of what it has always been admired for,” Nichols said. “Already new residential construction begins at the edge of the sidewalk, and is a minimum of three stories high. The biggest question many of us have is: ‘Will there be enough water for us to share with all the prospective newcomers?’”

Forum… Or Against ’em

When I was a child, Christmas, or the Christmas Season, did not begin until December. My impression looking back on it is that the season began in earnest sometime in the second week of the month, near or around December 12 or thereabouts, when people began to look ahead and do their holiday shopping. Gradually, over the years, it seems, the Christmas Season, or the preparation for it, has come earlier and earlier, so that now there is something like a hundred days of Christmas. At some point December First became the starting point for the Christmas rush. Then the day after Thanksgiving. In time, November 1 was the jumping off date. Then the middle of October. In this day and age, stores begin previewing Christmas in September…
This phenomenon, it seems, has carried over into the political world. When I was a young man, well  actually, when I was a middle-aged man, the presidential campaigns seemed to start in the month before the first primary election in New Hampshire or the caucus in Iowa. Many of those presidential election years, the frontrunners changed over the course of the primaries, with one or another of the most visible or obvious contenders besting one of the others in one primary and losing in another, with the leadership in the race swinging between contenders, sometimes dramatically. A few times, a dark horse emerged seemingly out of nowhere to capture the popular political imagination and maybe even the presidency. Usually, by either big party convention it was pretty obvious who the nominee was going to be, but my point is that previously the election wasn’t an issue of overriding concern until the year of the election. Nowadays, there are still Washington, D.C. municipal workers sweeping up confetti from the inaugural day parade and campaign workers are already hustling potential donors for campaign finance money for the election that is to ensue in three years and nine months…
This week Hilary Clinton, Marco Rubio, Ted Cruz and Lincoln Chafee all made declarations of their presidential candidacies. Before I go any further, I am compelled to digress and tell my readers that Lincoln Chafee, despite his name, is not a Republican, but rather a Republican-turned Independent-now turned Democrat. I think I need say no more on that score…
As I survey the political landscape, I am not terribly thrilled with the offerings. Some are better than others, but I hold the view that somewhere in the corporate world or in the realm of science or medicine is harbored a leader superior to any of our current batch of elected officials. I’ll give half of one of  General George Patton’s quotes here: “Politicians are the lowest form of human life.” I believe America is a wonderful place, but its political leadership leaves much to be desired…
Having said that, I am encouraged in one respect, namely that Cruz and Rubio have surfaced as potential standard bearers for the GOP,  which is, as many of you know, my party by choice. I have no particular objection to either of them, and they may well be of the highest order in the lowest form of life. I could see myself potentially voting for either of them…
We Republicans are in ascendancy nationally, having taken control of the House and the Senate. But we remain sadly out of power in the Golden State. This is largely due to the loyalty Latinos have demonstrated to the Democratic Party. My hope is that Mr. Rubio or Mr. Cruz will demonstrate that the Republican Party is the true party of opportunity and prompt California’s Hispanic voters to reevaluate their party affiliation and philosophical orientation.
