California Fish & Game Report Holds Threat To Joshua Tree Habitat Is Less Than Critical

The Center for Biological Diversity’s petition to have the western Joshua tree listed as a threatened species suffered a setback last month after a panel of scientists concluded available data does not conclusively demonstrate the plant’s habitat will fully disappear in the foreseeable future.
In October 2019, the environmental group made a request of the California Department of Fish and Wildlife that the western Joshua tree be listed as a threatened species under the California Endangered Species Act. The Fish and Game Commission is scheduled to make an ultimate decision on that request on June 16, 2022.
On April 13, the California Department of Fish & Wildlife released a report and recommendation completed in March which included a peer review of the available data relating to the Joshua tree assembled by Dr. Cameron Barrows of the University of California Riverside, Dr. Erica Fleishman of the Oregon Climate Change Research Institute, Dr. Timothy Krantz with the University of Redlands, Dr. Lynn Sweet with the University of California, Riverside and Dr. Jeremy B. Yoder from California State University Northridge.
Barrows, Fleishman, Krantz, Sweet and Yoder acknowledge the outlook for the plant, known by its scientific name Yucca brevifolia Engelm, is grim. “The population size and area occupied by [the] western Joshua tree have declined since European settlement largely due to habitat modification and destruction, a trend that has continued to the present,” the report states. “Primary threats to the species are climate change, development and other human activities, and wildfire. Available species distribution models suggest that areas predicted to be suitable for [the] western Joshua tree based on 20th Century climate data will decline substantially through the end of the 21st Century as a result of climate change, especially in the southern and lower elevational portions of its range.”
Nevertheless, the scientists said, “the department does not currently have information demonstrating that loss of areas with 20th Century suitable climate conditions will result in impacts on existing populations that are severe enough to threaten to eliminate the species from a significant portion of its range by the end of the 21st Century. The effects of development and other human activities will cause western Joshua tree habitat and populations to be lost, particularly in the southern part of the species’ range, but many populations within the range of the species are protected from development, suggesting that a significant portion of the species’ range will not be lost by development alone. Wildfire can also kill over half of western Joshua trees in areas that burn, and wildfire impacted approximately 2.5% of the species’ range in each of the last two decades, but wildfire does not appear to result in loss of range, only lowering of abundance within the species’ range.”
Barrows, Fleishman, Krantz, Sweet and Yoder said that “While the department recognizes the threats faced by the species, and the evidence presented in favor of the petitioned action, the scientific evidence that is currently possessed by the department does not demonstrate that populations of the species are negatively trending in a way that would lead the department to believe that the species is likely to be in serious danger of becoming extinct throughout all or a significant portion of its range in the foreseeable future. The department recommends that the commission find that the recommended action to list [the] western Joshua tree as a threatened species is not warranted.”
Brendan Cummings, the Center for Biological Diversity’s conservation director, decried the recommendation as one in which, “California wildlife officials just proposed open season on Joshua trees.” Inaction, Cummings said, will doom the species. “Before state protections took effect, developers were bulldozing these beautiful, fragile trees by the thousands to build roads, warehouses, power plants, strip malls and vacation rentals. If Joshua trees are to have any hope of surviving in a warming world, we have to stop the widespread killing of them.”

Intimations Of Extortion In 6-Year Extension Of County CEO’s Contract

San Bernardino County Chief Executive Officer Leonard X. Hernandez, who assumed the position of San Bernardino County’s chief executive officer in October 2020, was given a six-year contract extension this week.
Hernandez, one of the most ruthless and skillful inside governmental operatives in San Bernardino County history, occupies a position at the pinnacle of the county government’s staff structure, such that on the county’s organizational chart he is answerable only to the five-member board of supervisors. Nevertheless, through his accumulation of inside information over the last seven years and the number of actions he has taken directly or bureaucratically facilitated, he is in possession of what is essentially blackmail material which has rendered all five of the members of the board of supervisors both beholden and vulnerable to him.
There was little indication at the beginning of Hernandez’s public career of his hardened, razor-sharpened personality that would enable him to claw his way to the top of the county hierarchy. Indeed, in 1998, he began with the county as a mild-mannered, indeed innocuous-seeming part-time service employee at its Chino branch library, after which he went to work full-time for nearly four years at the Chino Hills branch library. By means of online coursework offered by Clarion University in Pennsylvania, he obtained a master’s degree in library and information science, and by 2005, was the librarian overseeing the county’s Fontana branch library. In 2008, Hernandez left the employ of San Bernardino County to become the library director for the City of Riverside, a definite step up in his then-chosen profession. In 2010 he applied for and was offered the executive director’s position with the Tumwater, Washington-based Timberland Regional Library System, which features 25 libraries located in a geographically dispersed section of west Washington, but ultimately declined the offer after learning that San Bernardino County Librarian Ed Kieczykowski was leaning toward retirement. Kieczykowski retired in 2011, and Hernandez returned to San Bernardino County to replace him. County officials were impressed by Hernandez’s performance and two years later, when the need arose, he was given a secondary assignment as the director of the San Bernardino County Museum while he was yet in the librarian post.
In 2015, then-County Chief Executive Officer Greg Devereaux, who himself is a personage of legendary governmental administrative stature within the county, promoted Hernandez to the position of county deputy executive officer overseeing the community services group, which includes the county’s library and museum systems, the registrar of voters, regional parks, county airports and the county department of agriculture/weights and measures. The following year, Devereaux conferred upon Hernandez the interim chief operating officer’s assignment.
Behind the scenes at that time, a struggle for dominance of the county’s power structure was ongoing between Devereaux and Fourth District Supervisor Curt Hagman, who had first been elected to the supervisorial post in 2014. By early 2017, Hagman had assembled enough votes and resolve on the board to ease Devereaux, who had a contract as chief executive officer running to 2020, out the door. Devereaux was prevailed upon to accept what was essentially a do-nothing or do-little management consultant’s position with the county and depart as county chief executive officer. Dena Smith, the one-time clerk of the board of supervisors whose qualifications for the interim CEO position consisted chiefly of unquestioningly having processed the documentation relating to the board’s meetings for a dozen years and having served as the fill-in supervisor of the county’s land use services department in a pinch and had been moved up to one of the deputy county chief executive officer positions during the latter stage of Devereaux’s tenure as chief executive officer, was promoted by Hagman as a logical interim replacement for Devereaux because he recognized how easily he would be able to dominate her. The board went along with Hagman, and Smith served as the interim chief executive officer for eight months. Thereupon, the board, controlled by the strong-willed Hagman, settled upon elevating Gary McBride, the county’s chief financial officer, to serve as county chief executive officer.
The affable and easygoing McBride was uncomfortable with being confrontational with county staff and department heads, and was thus constitutionally incapable of carrying out firings. Hernandez, in whose veins, seemingly, ran ice water, proved more than willing to act as McBride’s hatchet man. He relished, it appeared, such assignments, Throughout the county’s governmental structure, Hernandez become known, indeed feared, as what some referred to as “the grim reaper.” County employees en masse came to dread the prospect of looking up to see Hernandez make his way unannounced into his or her office, at which point he would close the door behind him and unceremoniously present the unfortunate employee with a pink slip to let him or her know he or she had been terminated and was to be separated from the county at once, oftentimes without the opportunity or privilege to clean out his or her desk.
Hernandez became valued by the board of supervisors for his decisiveness and willingness to act and carry out virtually any assignment the members of the board of supervisors, collectively or singly, with or without working through McBride, tasked him with. A standing joke was that one day McBride would look up to see Hernandez, in the form of the grim reaper he was celebrated by county employees as being, darkening the entrance into the county chief executive officer’s quarters, at which point McBride would learn that the board of supervisors felt that his time was past. Indeed, that is what came to pass in September 2020. County officials sought to drape McBride’s firing in window dressing, initially installing him in the position of the county’s “strategic projects director” at the same salary – $373,833.78 per year – as what he was receiving as county chief executive officer, while initially focusing on the county’s response to the COVID-19 pandemic and utilizing federal grant money in that effort. Thereafter, McBride faded from sight.
Little or nothing is lost on Hernandez, particularly if it enhances his reach or standing or hold on the office he occupies.
While Hernandez was yet employed in the capacity of chief county operating officer, Dawn Rowe was appointed to the board of supervisors in December 2018 to succeed James Ramos, who had resigned as Third District supervisor following his election to the California Assembly. Almost immediately upon Rowe assuming the role of supervisor, her office became a base for political operatives to promote her effort to remain on the board during the 2020 election as well as to support the 2020 election campaigns of then-Congressman Paul Cook in his effort to move into the position of First District supervisor, Assemblyman Jay Obernolte in his bid for Congress in 2020 to replace Cook and the attempt by Thurston “Smitty” Smith to move into the Assembly position vacated by Obernolte. To this end, Rowe hired three known political strategists/coordinators to serve as key elements of her staff, including her chief of staff, Matt Knox; her policy director, Dillon Lesovsky; and her communications director, Suzette Swallow. In 2020, Second District Supervisor Janice Rutherford and Hagman called upon Hernandez to undertake an inquiry that would assure the public that county employees including members of the supervisorial staffs were not engaged in campaigning from county facilities using county equipment on the taxpayers’ dime. In short order, Hernandez had damning evidence that various staff members in the county’s supervisors’ office, including Knox, Lesovsky and Swallow, Rutherford’s chief of staff Phil Paule, Rutherford’s assistant chief of staff, Mark Taylor, one of Rutherford’s district representatives, Ben Lopez, Hagman’s Chief of Staff Yekaterina Kolcheva and Peter Rogers, Hagman’s district director, had been involved in the 2018 and or then-ongoing 2020 election campaigns. In a tacit agreement with his political masters, Hernandez elected to overlook the circumstances in which Knox, Lesovsky, Swallow, Paule, Taylor, Lopez, Kolcheva and Rogers engaged in illegal political activity by utilizing public resources in carrying out electioneering activity.
By virtue of his position, Hernandez is now aware that former First District Supervisor/Assessor Bill Postmus has set up a political money-laundering operation and is seeking to influence Hagman, Cook and Rowe by means of money being filtered to them or into their campaign war chests to support with their votes on the board project applications or contract solicitations pursued by Postmus’s clients at the county. Hernandez and his successor as county chief operating officer, Luther Snoke, assisted a company in which Postmus is a minority Partner, Eagle 55, obtain project go-ahead and a $5.5 million guaranteed loan through the county. Hernandez and Snoke are further preparing to assist another Postmus client, Alliance Building Solutions, in securing no-bid contracts to carry out over $100 million worth of work relating to enhancing the energy efficiency of county buildings. Postmus and his partner, John “Dino” DeFazio, have requested and been accorded favorable treatment by the county’s land use services department. Hernandez had a clear window on efforts by Nachhattar Singh Chandi in which he utilized more than $50,000 in contributions spread around to local officials including Fifth District Supervisor Joe Baca, Jr. and supervisors Hagman, Rowe and Cook to purchase county approval of a truck stop in Bloomington that was not in compliance with the zoning code and which involved inadequate safeguards to prevent solvents, oil and fuels from leaching into the water table beneath the development. Hernandez is aware of preparations underway to have Tim Itnyre, Cook’s chief of staff, replace him as First District supervisor in 2024 and have Dakota Higgins, Cook’s assistant chief of staff, move into the position of Itnyre’s chief of staff. Hernandez understands that Itnyre and Higgins stand at the crossroads of money Postmus is conveying into Cook’s electioneering fund, which is ultimately to be transferred to and used by Itnyre in his 2024 campaign, and the votes Cook will make in favor of the business interests which have entrusted money to Postmus to deliver to the various supervisors to ensure the passage of the project proposals or contracts pending before the board of supervisors in which those donors have an interest. Under Hernandez, Matt Knox, the political operative who formerly served as Rowe’s chief of staff, was moved into a position as one of Hernandez’s underlings, with the title of deputy chief county executive officer.
The county in February turned down a request by the Sentinel, filed under the California Public Records Act, for Hernandez’s meeting calendar going back to the beginning of his tenure as county chief executive officer, using the office of county counsel to assert that Hernandez’s calendar is exempt from disclosure. County employees have told the Sentinel the calendar illustrates the way in which Hernandez is assisting entities who are filtering money to the board of supervisors in achieving their ends. Hernandez and the board of supervisors within the last few months established Tom Bunton, who was brought to San Bernardino County from San Diego County recently and has no institutional knowledge or understanding of the degree to which Hernandez has used extortion of the board of supervisors to advance himself, as county counsel.
The 42-year-old Hernandez’s youthful appearance, upon which Supervisor Cook often makes reference, belies his ferociousness in maintaining his primacy at the apex of San Bernardino County Government, the iron fist beneath a velvet glove which he adroitly wields. Hernandez further masks, with a cheerful and friendly veneer, the single-minded determination he embodies to dominate the county administrative building, which is chock full of A-type, alpha personalities, elected and otherwise, who similarly have their hearts set on dominating any of those in their orbit who they can.
In taking their unanimous action to offer Hernandez six years of job security, the members of the board gave no hint that they might themselves actually be under his thumb and are being extorted by him.
“I’m pleased to introduce this item,” said Hagman. “Dawn [Rowe] and I, the vice-chair and I, had the chance to meet with our CEO Hernandez to talk about his extension. We believe that he’s really taken the county in the right direction over his short time period here. We really appreciate the way you and your team has (sic) been working together to bring the county forward and support our residents, especially in this time of emergency. We thought for stability purposes, that the six-year contract, which is similar to what we’ve done in past CEOs, had that stability factor that we needed.”
Hagman assiduously avoided delineating what Hernandez’s salary and benefits are to be.
Currently, Hernandez is reportedly provided with a $369,000 salary, some $95,000 in add-ons and pay augmentations, and another $209,000 in benefits for a total annual compensation of $673,000. He is to receive an annual pay increase of 5.0623 percent, consisting of a 2.5 percent increase every six months. Thus, by October 2028, he will have seen his salary alone boosted to $498,920.95 per year. Assuming his benefits and add-on pay do not increase from what he is currently receiving, by October 2028, Hernandez’s total annual compensation will stand at $802,920.95.
Without citing dollar figures, Hagman emphasized that at present Hernandez is making less than his counterparts in Riverside County and Los Angeles County.
Cook said of the move to extend Hernandez’s contract by six years, “I support the action. I think he’s doing a great job. I think there’s a certain harmony. When you have the talent, age is not a factor.”
Supervisor Baca said, “I think the big thing that’s important for this county is having some stability. I appreciate Leonard’s leadership and really following through on our efforts and our vision of the county.”
Without dissenting, Second District Supervisor Janice Rutherford noted “My personal preference is that a board negotiate a contract with the executive officer at the time of his or her annual evaluation rather than putting automatic step increases into the contract. The subcommittee decided to negotiate differently that time. That’s my personal preference. It doesn’t keep me from supporting this contract. I think Mr. Hernandez is doing a fine job and brings stability to the organization. That is what motivates the rest of the contract, but I would encourage the board to look to changing that in the future.”
Rowe’s verbal endorsement of Hernandez at the meeting consisted of her seconding of Cook’s motion to approve Hernandez’s six-year contract extension. The contract extension was approved unanimously.

Citizens Push Further Moves To Regulate Short Term Rental Units

The ongoing effort at intensifying the regulation of short term rentals in several geographically diverse places around 20,105-square mile San Bernardino County progressed last week as both Big Bear Lake and Twentynine Palms took fitful steps toward revamping or creating limitations on properties used by vacationers.
In recent years, those who permanently live in proximity to cabins, rooms, units and even trailers that are made available for people to live in for relatively short and in some cases longer periods at popular vacation spots in mountain and desert locales as well as on the shores of lakes or the Colorado River have grown increasingly vocal in complaining about their transitory nearby residents. On occasion, especially when alcohol or recreational drugs are involved, the behavior of some of those vacationers is not as civil as their temporary neighbors would prefer them to be. In some cases, quarters that are intended for a few people or a family or two is called upon to accommodate several dozen. That brings with it issues such as noise, overburdened parking space and compliance with rudimentary laws. On rare occasions, with no warning a rave-like event manifests in a place ill-suited for it, and things can quickly rage out of hand.
In particular, the unincorporated communities of Mt. Baldy, Joshua Tree, Wrightwood, Crestline, Cedarpines Park, Lake Gregory, Lake Arrowhead, Blue Jay, Valley of Enchantment, Cedar Glen, Sky Forest, Twin Peaks, Arrow Bear, Big Bear City, Angeles Oaks, Forest Falls, Running Springs and Green Valley Lake have experienced such social disruptions, as have the three incorporated municipalities of Big Bear Lake, Yucca Valley, and Twentynine Palms.
In 2017, county government made a concerted effort to deal with the matter in the mountain communities. In 2019, the county moved to take up the issue directly and generally, not just in the mountains, but in desert communities, in particular ones along the Colorado River as well as those near, in and around Joshua Tree National Park, which includes Morongo Valley, Yucca Valley, Joshua Tree, and Twentynine Palms. The county imposed on short-term rentals renter identification/registration and on-site parking requirements, exterior and interior maintenance standards, a mandate that evacuation maps on all doors within each unit be posted and fines of $100 on the rental units’ owners for a first offense, a $200 fine for a second offense and a $500 fine for a third, as well as like penalties for disturbances at the units. In 2021, after those earlier efforts proved less than fully effective, the county upped its fines to more draconian terms, those being that offenses were no longer considered administrative but criminal, subject to penalties of $1,000 for the first offense, $2,000 for the second offense and $5,000 for the third offense falling within a 12-month period. Operating a short-term rental unit without a permit was subject to the same $1,000, $2,000 and $5,000 fines per violation per day.
In Yucca Valley, where residents endured problems brought on by insensitive short term visitors, the town government in 2017 approved an ordinance that imposes on the owners of residences rented out as vacation homes a requirement that they apply for a $270 permit every two years and pay the same taxes imposed on hotels. Permit fees are used to fund the cost of the town hiring a private company to monitor the properties, enforce codes and deal with complaints relating to the properties emanating from neighbors.
The most intensive controversy over short term rentals and the call for their regulation is in Big Bear Lake, San Bernardino County’s second smallest city populationwise at 5,338 and third smallest geographically at 6.42 square miles. As a recreational and vacation mecca, Big Bear Lake attracts thousands of short term occupants annually, with arrivals coming in during all four seasons of the year. Consequently, a substantial number of property owners in Big Bear Lake, some who do not actually reside there, derive considerable income from catering to these short term residents. They are less in favor of the city government imposing regulations on the transient population than are the homeowners in the city who must live with a constant influx of highly unpredictable temporary neighbors of variable levels of gentility. The Big Bear Lake City Council has thus found itself caught between on one side the full-time residents who want tough restrictions imposed on rental units and on the other side the often-absentee landlords who are making a substantial amount of money by renting their properties on a temporary basis and want nothing in place that will discourage renters from coming to Big Bear Lake.
The city council, a majority of which has been more responsive to the wealthier absentee landlords, responded by initiating a regulatory regime that involves licensing and fines on cabin owners on whose properties problems manifest, with the potential for revocation of those licenses if the nuisances persist on a given property. A contingent of city residents who did not believe that City Hall had gone far enough formed on April 25, 2021 a group intended to lobby for more vigorous regulation. Its members made a concerted call for a cap on vacation rentals and they are pushing the city to increase the transitory occupancy tax – i.e. the city’s bed tax or hotel tax – to be upped from 8 percent to 12 percent, based on their argument that 35 percent of the calls for service from the fire department or sheriff’s department involve short term rental properties and/or visitors to the city. In August 2021, the Big Bear Lake City Council voted 4-to-1 against a proposed cap on vacation rental permits. The controlling council majority members said they want to give the regulations that exist an opportunity to work. If those do not achieve the desired results, they said they might then put more restrictive measures into place.
On October 21, 2021, the group animated about the issue of vacation rentals changed its name to Big Bear Lake United to Limit Short Term Rentals. Thereafter, it embarked on an effort to bypass the city council and set about gathering signatures on a petition to place on the October 2022 ballot an initiative calling for a limit on the number of vacation rentals in the city. In that same election, three positions on the Big Bear Lake City Council are up for election.
In the meantime, a contingent of residents is seeking to recall City Councilman Alan Lee. Lee, who has emphasized cases where locals have been victimized by visitors, including incidents of vandalism, theft and violence, is the lone champion of Big Bear Lake’s residents seeking to intensify restrictions on short-term rental units on the council, as the other four council members have sided with the absentee landlords on this issue. The group seeking Lee’s ouster has obtained 370 signatures on its petition. Under California law, a recall petition drive to succeed must be signed by 25 percent of the number of voters who voted in the previous gubernatorial election. While neither the Big Bear Lake City Clerk nor the San Bernardino County Registrar of Voters Office this week could say with precision how many voters in Lee’s District 1 voted in the 2018 election, there were a total of 475 voters in District 1 who came to the polls or submitted mail ballots in 2020. Using that as a guidepost, it would appear that those seeking to force a recall of Lee have likely met their burden to put the matter before the city’s voters.
Thus, the battleground between the pro-vacation rental business/tourist industry element of the Big Bear community and its full-time residents has been clearly demarked, such that the November election will have four races in which the city’s two opposite contingents – those supporting short term rental unit limitations and Lee on one side and those opposing further vacation unit limitations and supporting council incumbents Mayor Rick Herrick, Councilman Randall Putz and Councilwoman Perri Melnick on the other – are starkly apparent.
In Twentyine Palms, the planning commission for the last several months has taken up the issue of updating the municipal code relating to vacation home rentals in the 28,065-population city. Based on the flow of discussion and attitudes of the city’s five planning commissioners, it appears that there is some will to harden the city’s stance with regard to the influx of short-duration residents, although no precise consensus on numbers could be formed. Commissioners Leslie Paahana, Jason Dickson and Max Walker are all on board with capping the number of vacation rentals the city will allow and seem comfortable limiting that number to somewhere near one-tenth of the 5,797 houses in the city. Commissioner Jim Krushat entertains the concept of limiting the rentals, but expressed a preference for a limitation closer to 20 percent. Commissioner Greg Mendoza has said he does not think it is the city’s place to engage in such regulation and that the free market should determine who will rent short term or long term. Meanwhile, large numbers of residents have lobbied for a 5 percent cap.
Chairwoman Paahana at a March 1 meeting pushed for a cap of 10 percent, which would have levied a restriction of 578 vacation units. Krushat countered with a 19 percent proposal, or 1,101. At that point, the council majority indicated it would likely recommend a compromise of 12 percent, or 696. They postponed, however, making a final recommendation.
They were scheduled to meet again on April 6. The meeting was held, but Pahaana and Dickson were absent. At one point during the discussion, concern was expressed that limiting vacation rentals would result in an escalation of rental rates, which might redound to the detriment of long-term renters in the city. As Walker was the only advocate of the 12 percent compromise present, the trio of Walker, Krushat and Mendoza were unable to come to a consensus. Accordingly, the Twentynine Palms City Council will take up the issue on May 10 without a recommendation from the planning commission.

Reservations On Architectural Quality Delays Redlands Mall Replacement Approval

VPV State Street Village, LLC’s hope that it could redevelop 11.5 acres of the now mostly dormant Redlands Mall on the cheap by utilizing off-the-shelf “modern interpretive” architectural schemes ran into a snag this week when a significant element of the city’s old guard questioned why the developer was skimping on the project’s outward presentation.
The Redlands Mall, located in the heart of downtown Redlands, was constructed in the mid-1970s. It shuttered as a full-scale commercial concern thirteen years ago, when its anchor tenant, Gottschalks, filed for bankruptcy. The only remaining tenant is CVS Pharmacy. In the aftermath of the mall’s demise, in some measure because of the economic downturn of 2007, there was little interest in the investment and development sectors in reinvigorating the site as a commercial center. This created a degree of anxiety among Redlands officials. Following the end of the recession in 2014, Brixton Capital proposed the redevelopment of the mall property. Brixton, however never performed.
In the aftermath of the Brixton debacle, VPV State Street Village made overtures about reclaiming the property. In doing so, VPV pushed Redlands city officials toward the intensification of density in the downtown core. The prospect of densely packing the city’s commercial district with people has put a large cross section of Redlands residents on edge.
Redlands, which was incorporated in 1888, has long been considered San Bernardino County’s most refined city, what many considered an idyllic blending of upscale homes and orange groves. With the gradual and eventual wholesale destruction of the citrus industry that began regionally in the 1950s and accelerated in the decades thereafter, Redlands residents more than those of other local cities pushed back against the urbanization trend, passing controlled-growth initiatives Proposition R in 1978, Measure N in 1987 and Measure U in 1997, all of which were intended to reduce growth to manageable levels.
Despite that sentiment among a sizable contingent of the populace and the force of law the measures provided in limiting development, members of the city council have over the last generation proven determined to clear the way for landowners and the builders they work with to construct projects that will more than double, triple and quadruple the density of residential and commercial land use, while compacting these improvements in smaller and smaller spaces near the city’s downtown core.
City officials in recent years have promoted what is called the Transit Villages concept. That approach calls for the city to encourage the development of three heavily populated districts within the city, all of which are located within walking distance of the commuter stations along the yet-to-be-fully-realized-and-actuated regional rail system urban planners are seeking to create on the existing train line running from Los Angeles and to Palm Springs. Three such transit villages are envisioned for Redlands, one downtown surrounding the city’s historic train depot, one on New York Street and one near Redlands University. The transit districts will entail a series of high-rise apartments to house individuals who travel most often not by car, but use public transportation. There is some debate as to whether these residents will be families or mostly unmarried individuals or couples without children. Though urban planners say these downtown denizens will not often use their own personal vehicles, the city yet plans to make places for their cars, which will generally be parked in structures as high as six and seven stories.
There has been substantial citizen resistance to this plan, but so far those proposing projects in keeping with this vision in Redlands have been warmly received by the city council, the planning commission, city administration and the city’s planning division. Indeed, the Redlands City Council made a determination that VPV State Street Village’s proposed project is exempt from the controlled growth Measure U initiative.
This week, on Tuesday April 12, the planning commission considered VPV State Street Village’s proposal which calls for 11.5 acres at the mall site to be converted into a mixed-use project that includes residential and commercial uses within five new multi-tenant buildings. The project calls for demolishing existing on-site buildings and improvements; erecting five mixed-use buildings up to four stories high; building up to 700 multifamily dwelling units, i.e., apartments and condominiums, to include studio, one-bedroom, two-bedroom, and three-bedroom, and live/work units; constructing an approximately 6,000 square-foot recreational amenity building including a pool and other private courtyards for residents; creating up to 71,778 square feet of commercial floor area on ground floors to include retail and restaurant uses, as well as a rooftop restaurant; constructing up to 12,328 square feet of office space on upper floors; establishing a pedestrian plaza totaling approximately 22,742 square feet on Third Street; constructing a five-level above-ground parking structure with 686 spaces; and excavating to build two subterranean parking garages with 269 and 225 spaces. Included in the plans are public and private open space areas to involve landscaping, shade trees, street trees, and pedestrian improvements; and related site improvements to include sidewalks, driveways, landscape, lighting and street lights, storm drains, flood prevention features, and public and private utility connections.
A substantial number of Redlands residents have not been pleased with the proposal, and have suggested that city officials, including members of the city council, the planning commission and city staff have conflicts of interest growing out of the intensification of density in the downtown area. Moreover, there is a perception that based upon both city staff’s and the city council’s frustration with, first, the extended period during which the mall property stood dormant and, second, Brixton’s failure to perform, that the city is being overly indulgent of VPV State Street Village, which has taken advantage of the situation and is proposing a project that involves not only excessive density but aesthetic and architectural standards that are not in keeping with the city’s traditions and elevated status above its counterparts in the county. Despite multiple protests to that effect by city residents, the widespread expectation going into Tuesday’s meeting was that the planning commission, which was not given ultimate land use authority on the VPV State Street Village project but was being called upon to evaluate it and provide a recommendation to the city council which will ultimately determine whether VPV State Street Village should be able to proceed with the project and under what terms, would put its imprimatur on the proposal. Prior to the meeting, the city’s planning staff, led by City Planner Brian Foote prepared a report recommending that the planning commission adopt a resolution that it recommend the city council certify an environmental assessment of the project to the effect that it is in compliance with the California Environmental Quality Act, approve a general plan amendment to allow the project to proceed, approve a conditional use permit for the project, approve a development agreement for the project and endorse the project in general.
Despite those expectations, two former mayors, two city residents with solid urban planning credentials and the host of a national television show that focuses on the preservation of historical buildings expressed reservations with regard to the architectural standards VPV State Street Village is adhering to in the project proposal.
Brett Waterman, a building preservationist based in Redlands, said, “There is so much about this project that I like.” Nevertheless, Waterman said, there was a problem with the “modern interpretation” of classic architecture that was to go into the project.
“We in the city of Redlands are really rooted in historic architecture,” Waterman said. “You can see it everywhere in our city. I think there’s been attempts to bring modern elements in the city, but it doesn’t really feel like Redlands. So, I would challenge them [i.e., VPV State Street Village] to look at modern interpretations of historic architecture and go back to something more historic, something that feels more familiar and supporting the fabric of what makes our city unique. If we want our city to stand out from other cities in California, I think we need to embrace what has made us successful in the past and its historic classic architecture, be it mission revival, Victorian, arts and crafts. We have it all here. The architecture I’m seeing – very modern – waters down all of it, so it becomes a little more bland. I think that’s a challenge.”
Waterman, while advocating that the city not rush into approving what VPV State Street Village is selling, was still, like many of those speaking Tuesday off-kilter with many in the community opposed to the project in that he indicated he was not bothered by the project’s land-use intensity and density nor by its multi-story nature.
Karl “Kasey” Hawes, who was a member of the Redlands City Council from 1999 to 2003 and mayor from 2001 to 2003, told the commission, “Redlands has special attributes and architecture that is unique. That is the reason we all love living here.” Saying that many buildings in Redlands are “magnificent structures,” Hawes said, “All of those things and the touch and feel of Redlands is extremely important.”
Redlands residents, he said, “love historical redevelopment.” Of the city’s character, Hawes said, “They want it to be preserved. That brings us to this project. What’s good about it? The mall needs to be redeveloped. And it needs to be done soon and this is a fantastic layout and it’s a fantastic idea and a fantastic concept. The problem is when you start labeling our architecture as eclectic, exuberant, antiquated, devoid of containment, it opens yourself up for the opportunity to do anything you want and claim it falls within the guidelines. We have architectural guidelines, and I don’t think many of these elevations on the outside reflect those guidelines.”
Hawes said, “The solution is to convene a special meeting of the planning commission and city council to approve this project and do it after we’ve had a chance for additional input on the exterior architecture.”
Deborah Barmack, a Redlands resident who was formerly the executive director of the county’s transportation agency, said she supported the transit villages concept and what she termed “meeting housing mobility goals.” She said she was “eager to see the mall demolished and make way for a project we can all be proud of but I would like to see development that fits the character of the City of Redlands This is why the City of Redlands architectural guidelines were developed.”
Those guidelines, Barmack said, call for “nonresidential development of the highest quality that will further enhance the existing character of the community. This development as presented is not yet the highest quality and certainly does not enhance the existing character of the community. I urge you to ensure that the architectural guidelines that are incorporated in this project’s design reflect the values and the input from this community.”
Garry Cohoe, the former city engineer for the City of Chino Hills and a resident of Redlands, said he did “not think the proposed architecture complies with the architectural guidelines” the city has in place.
He said VPV State Street Village’s plans for the building to be constructed at Redlands Boulevard and Eureka Street are “supposed to resemble in some way the [historic Redlands] train station. I don’t see it. I don’t see it representing Redlands in any way. In fact, it looks institutional to me.”
Elsewhere in the project, Cahoe said, there was “no variation in the rooflines. There is one steady roofline.”
All the way around, he said, what VPV State Street Village is proposing does “not meet the intent of the architectural guidelines.”
Additionally, Cahoe said that the development agreement the city was contemplating with VPV State Street Village was not stringent enough. He said the city needed to “tighten” the agreement to ensure that VPV State Street Village has to perform to prevent the property from languishing for another 15 years.
Carole Beswick, who was on the city council for eight years, including an extended stint as mayor from 1983 until 1989, said the project “is going to have a major influence on the character of this city for decades to come. We’re all eager to see the renovation of the mall. I think this project has tremendous potential but we don’t want to replace it with something of which we can’t truly be proud. We’ve worked hard to preserve the character of Redlands while supporting all kinds of development, but let’s not deviate on this one, on such an important project.”
What is being proposed, Beswick said, was “massive rather than charming. I think it’s really important that what we have here as an end result celebrates the city and does it in compliance with our objective architectural guidelines to get close to something that respects who we are.”
Ultimately, the planning commission, while hailing the project as one that would do away with the blight of an empty and dormant mall, concurred that the project’s character needed to be improved.
Steven Frasher, the planning commission’s chairman, indicated the panel was not ready to recommend the project as it is currently proposed to the city council. He said, “I agree with the former mayors in their presentation that having a bit more conversation about some of these elements, I think, can get us over the hump.”
If VPV State Street Village is willing to adjust certain elements of the proposal, approval of the project should be coming in relatively short order, he said.
“I don’t think there is an appetite for needless delay or throwing a big wrench into what we heard broadly as a very attractive proposal well presented and thoughtfully put together,” Frasher said. “As several of us have heard from several voices, we heard the same thing: We have one chance to get this right, so collectively, I think with the mayors’ encouragement, I think we can get there if we can meet together.”
The planning commission, taking no action on the project itself, voted to continue the meeting, as Hawes had suggested, to a future joint meeting of the planning commission and city council dedicated to the project.

Devore H2O Company Customers Questioning Land Lease Deal With Company Board Member

Customers of the Devore Water Company have grown alarmed over a decision by the company’s board of directors to commit millions of dollars to a project to construct a water storage facility on property owned by one of the board’s members.
Of note is that the board member on whose property the water tank is to be constructed is also the water company’s treasurer, who has sole access to the company’s financial books.
Multiple customers of the Devore Water Company have told the Sentinel they believe Doug Claflin, a board member who owns or controls a significant number of the company’s shares, has involved himself and the company in a conflict of interest that is subjecting the company to both current and long-term financial hardship.
The Devore Water Company has existed for over a century and supplies water to users in the community of Devore located around the junction of Interstate 15 and Interstate 215.
The company is an uncommon amalgam of a private entity and a service provider which serves in a semi-public capacity of supplying water to local residents, businesses and landowners. Because it is not a public entity, per se, information relating to its operations is not easily available. Moreover regulations governing public entities and how they are run, particularly with regard to the availability of information pertaining to management decisions, for the most part do not apply to the company. Reportedly, there are 150 shares in the company which are owned by roughly 75 customers. To obtain water from the company, a meter is required. All meter owners are given a single share of stock in the company. Those who have either sold their property or moved without selling their property lose their shares, which are then made available to the company to distribute. Shareholders have told the Sentinel that this distribution of shares occurs in a rigged lottery process in which the board members over the past two to three generations have consistently and without exception come into possession of the shares when they are made available. Additionally, the Sentinel is informed, a minority of the board members have effectively persuaded shareholders to surrender to them the authority to vote on their behalf by proxy. There are, the Sentinel is told, at least two dissident board members, but the board majority dominates the company. Previously, minutes of the board meetings were kept, but that is no longer the case. Devore residents have complained that action is taken by the board that is not disclosed, and that only after, in some cases months after, the board’s action does the public become aware of what has occurred. In such circumstances, efforts to participate in the company’s decision-making process are ineffective. On April 12, a board meeting was held at which an effort to video the proceedings was made. The board insisted that the videographer desist.
According to several company customers/shareholders, contamination of one of the company’s wells has necessitated that the company blend that well’s water with water from uncontaminated sources to reduce the saturation level of the contaminant in question to levels that bring the company’s water supply into compliance with State of California Department of Health standards. The water to be blended is to be stored in a cistern or tank at an elevation in the community, which lies at an altitude of between approximately 2,434 and 2,828 feet, that would assist in a gravity feed of the water to a majority of, or all, the company’s customers. The company has already committed or spend $500,000 for engineering and design work on the cistern, which is to cost between $5 million and $6 million to construct. A landowner of property at the elevation appropriate to accommodate the cistern was willing to donate a piece of ground to the company. Instead of accepting that offer, however, the Sentinel was told, the company entered into a 99-year lease with Claflin to utilize a portion of his property, which is adjacent to that of the resident who was willing to provide his land gratis to the company. Precise financial figures relating to the water tank project are not available, and Claflin, as a board member and the company’s treasurer, has not made that documentation available to either the general public, which has no legal right to the company’s financial data, or the company’s customers and shareholders, who do have a right to that information.
Unconfirmed by the Sentinel was that Claflin, who is also the assistant superintendent for business services with the Etiwanda School District, and/or his heirs, stand to make somewhere in the neighborhood of $1.5 million from the lease of the property.
On Thursday, in response to an inquiry by the Sentinel, a secretary at the company said that Tiffany Leone, the company’s office manager, would respond to questions relating to the arrangement with Claflin. When Leone did not make contact with the Sentinel as had been indicated, the Sentinel tried to initiate contact with Leone, who was not available by press time.
